Rent Recovery Solutions

Ok, so first let me explain how I got in to this mess....in 2010 I moved to Georgia. Before I got there I had rented an apartment in a friend's complex. Upon move in (before out walk through) we found the place to be completely roach infested (I mean BAD, once it was night time they swarmed the place). We immediately rejected the unit and told them we were not interested in living in the complex. 

 

Months later, I was checking my credit reports to find a collection from that apartment complex sold to a collector called Rent Recovery Solutions. I immediately called the apartment complex and asked questions. They said they had mailed me a letter to the address of the apartment that I never officially moved into assuming I had my mail forwarded....it supposedly stated that I returned the keys late and was being charged. They never called and I never got a letter...why would I forward my mail from an apartment I never moved in to? 

 

Anyway, the collection is only for 45 dollars. I have called the collection agency and asked if I could pay for a deletion several times. They are not interested in that. Since I do not feel I owe anything, I would only be paying for them to delete the entry on my Experian report. I've tried disputing it and I have had no luck.

 

Any suggestions or advice?

When did you return the keys?

 

Did they have the address from where you were supposed to moving from?

Unless you have something in your documents showing you could have been responsible for the 45 dollar fee. File suit against the collection company & rental complex using small claims.

That should get there attention.

I called and let them know when I was returning my keys. They said it was fine and I never thought another thing about it.

Can I do this even if I now live in a different state? I got a job in Texas and am wanting to buy a house. I've been working so hard on my credit and all of my scores are in the 700's now. There's just this blemish and a 30 day late pay from 4 years ago that I'm trying to clean off before I apply for a mortgage.

Bottom line is this if your state allows you to sue from where you are at then you sue them for 45 dollars in small claims court.

 

Do you think they would want to spend 1500 - 2000 dollars on a lawyer?

Do you think they would intend to fight you for the 45 dollars?

Would they have documents still now showing the proof of the contract in court?

 

Answer is in my opinion "not likely".

 

 I would file small claims for 45 bucks including court fees you cannot sue for removing it off your report but you could get the 45 bucks back and more then likely you will get a phone call when you put your cell phone on the court paperwork. Always put the CEO or head of the companies when filing suit not the company name. Check your local state courthouse to confirm you can file against a company out of state.

 

I've done this three times and all three times they bended down to me even one of my creditors had an amount of 750 dollars.  And I get my court fees back too.

Get my drift?
