S.O.L in PA..

Does anyone know the S.O.L for charge offs in PA? Or is 7 years for all states?..

6 years for legal action but CA can continue to their attempt to collect debt  indefinitely.  

It will be on your credit report for approximately 7 years

The statute of limitations refers to the period within which a debt owner must initiate civil action seeking a judgment. and by type It varies by state and by how the debt was established. 

 

The period for exclusion from your credit report is totally independent of the SOL for civil action.

It is set under the FCRA, and is no later than 7 years for monthly delinquencies, and no later than 7 years plus 180 days from DOFD for collections and charge-offs.

 

The FCRA periods apply to all states.  States can set their own exclusion periods provided they are shorter than the federal maximum period.

To date, New York state has a shortened exclusion period of 5 years for collections and charge-offs, provided the debt has been paid.

I just looked on my EX report from annualcreditreport.com which has my charge off with a deletion date of 2027.. it appeared on my report 2015.

A 2027 removal date for a charge-off or collection is an obvious error.

The CRA creates an estimated exclusion date by adding approx 7 years, but no greater than 7 years plus 180 days, to the reported DOFD.  See FCRA 605(c).

A CRA estimate of an exclusion date in 2027 means the reported DOFD was in late 2019 or in 2020.  That is not possible.

 

I would contact the CRA and check on the reported DOFD.  You appear to have a typo in your credit report.
