Santander Consumer check received

Hello!

 

Long story... I had an auto loan from Santander in 2016. It was totaled 1 month after I got it. My insurance and GAP paid them off. They later (2017) reported a loss of $49 to my credit reports. It then was changed to show $49 written off, $107 owed... I've called them over 20 times to dispute and to no avail. I paid the $107 on January 12, 2021. Today, 2/6/21 I received a check for $38.85... it cites my vin number, make/model. No other reasoning. I am in TX so we aren't in the class action lawsuit. They have clearly misrepresented their reporting and wrecked my credit. 

I'm not chasing the check.. but, I'm baffled and outraged... and I'd like to know what you all think I should do? Especially after they certified my debt as correct so any times during disputes. 

Do I have legal grounds for removal? Advice please!

p.s Insurance paid the same month, then GAP coverage. 3 months later they made my insurance company send another $980 to close it out. They were paid way more than my loan and still did this to me...

Update. I spoke to an accounts manager who said the amount is clearly incorrect but he doesn't know why. He's escalating the issue. I recorded the call and made that known to him. I also made my demands for a proper update to CRA's clear, but who knows. He also stated the additional fees were just over $58 and processed after the charge off due to nonpayment. I went off about it being illegal but he didn't care much and wanted it sent to someone above him by that point.

 

I made it clear I have the emails and checks paid proving my debt was never late and paid in full. He stated they'd call back by Tuesday. I know a lot of people have been hurt by them, so I'll update as this progresses.

Thanks! Here's to hoping they fix their mistake! It would skyrocket my credit...

Leading up to the accident and after the accident up to the day GAP and your insurance paid were you up-to-date on ALL your payments? Had you ever missed a payemnt by even 1 day or skipped any payments at all on a deferrment, etc?

 

If ANY of the above applies, the amount still owed could have been interest due on the account as GAP does NOT cover interest/fees, etc due to missed or skipped payments of ANY kind...even if lender approved.
