Sent a counter-offer to CA

Sent it PFD.  They are calling my parents home asking me to call them back everyday multiple times per day.  In my letter it says to write back to me if they accept.  However I did not tell them to stop calling.  Not sure how they got my old home address though.  The 15 day mark is Sept. 23rd.

Any suggestions?  Should I call them back?

Don't call them. They will lie, belittle you and just get on bad. Wait to see if they respond to the letter.

Re: Sent a counter-offer to CA

I decided not to call them.  I really want them to stop calling my parents home.  No one is there during the day and by then time they get home its almost 9pm.  They just leave messages on the voicemail telling me to call them.

They are not on my CR.  Its for a Target card and I tried several times to contact them but they kept sending me back to the CA (NARS).  The CA is not listed on my CR at this time but they have done a Inquiry so I would htink that it would be on there soon.  I just realized that it made no sense to send a PFD since its not on my CR.  Let me go double check.  I am an idiot....its not on my CR....I am sure it will be soon.   Now what do I do?  Call Target again make them talk to me?

The last time I made a payment to Target would have been June or July of 07.

Re: Sent a counter-offer to CA

Can you PIF?       DV the CA   CMRRR  now!!  Then they can not report for another 30 days or until they validate.  This gives you time.

If Target is reporting with a Bal.    and you can PIF.......send the payment with the check made payable to Target & use the complete restrictive endorsment!!!!

Re: Sent a counter-offer to CA

I have the amount of the initial settlement offer so I cannot PIF right now.  But if i send the DV tomorrow morning, then by the time I get a response from them I would have the entire amount needed to PID.  I am getting the letter ready RIGHT NOW!

Re: Sent a counter-offer to CA

I hate to sound like a jerk, but something to bear in mind when saving up for the pay-off:

Since you'll be DVing them (and cluing them onto the fact that you understand FACTA and FDCPA), and I'm going to assume that the SoL hasn't run out yet, so be prepared for them to file suit against you. I'm not saying they WILL, I'm only saying be prepared for it and by the time 30 days rolls around, have a plan of action.

Best of luck!!!

Re: Sent a counter-offer to CA

I thought about that as well.  I did find out additional information.  I was able to call Target and was told they had sold the account to NARS last month.  That is why its not showing on my credit report yet.  They said it can take 30-45 days.   NARS sent me a settlement offer I am assuming right away.  I have not heard from them in writing concerning my PFD.

I also called my other CC company (JCPenney) and found out they just sold my account to a CA called Sherman Financial they did this the last week of Aug.).  I am going to look this company up to find out what they are all about and also I guess wait for it to appear on my CR.  Do you think I should contact them now to see if they will agree to a pay-off so that they will not report it?

In total between the two bills they amount to about $1100.Smiley Sad

Re: Sent a counter-offer to CA

As re your JC Penny/Sherman account, I'm 99% sure that before they can begin to report, they have to notify you in writing and give you the chance to dispute the account/information.

Someone else will more than likely chime in on the legalities ... but I'm pretty sure they can't just report right off the bat. If you don't actually have the $$ to pay them off NOW, I'd wait until they contact you and then pay them.

Again, someone else might chime in (hoping they do -- nowadays, my head's full of other stuff -- like swim team practices, karate classes, pasta potluck dinners, etc) with another POV.

Who offered the initial settlement? If it was the OC the CA might refuse it!

Send them a DV   CMRRR

When they answer it you can try for a PFD.
