I have a delinquency on my credit report that was spotless until now. I have been paying for my big sum student loans for about a year now but about a month ago while applying for a private loan I was rejected due to a recent delinquency. After researching further, I found out that I had a 2nd student loan (a smaller amount) that I owed directly to my University - Federal Perkins Loans. Ever since I graduated I did not receive any emails/mail/phone calls regarding this specific loan so my account was never set up and I thought that I have been properly paying everything on time. Around the time that I relaized what was going on, the loan agency (ACS) switced to another agency (Heartland ECSI) but they still reported my delinquency which was 30 days late. I was told to apply for forbearance with the new agency to try to remove the delinquency but it only cleared being late with the new one, and not the old. Is there any way around this to somehow remove this off my record. When I call my school, there is only one person that is handling student loans and she pretty much tells me to forget about it and move on. I have heard of appeal letters and other strategies, but what do you think I should do in this case? My delinquency is with my old agency who is not working with me anymore and my school isn't willing to help out. Is there a way to fight that they did not contact me at all about this. They told me it was a bad address that caused the lack of communication, but they didn't even call or email me (Even after I was delinquent). I know that it is ultimately my mistake, and I should have been more responsible, but there are so many loans/agencies/etc that we deal with, it would be helpful to receive the proper information to pay up loans. Any advice would be helpful. Thank you.

If you assert that the loan was "never set up" and thus not valid, you will likely need to get that matter before a judge for consideration of the facts and a ruling as to its legitimacy.
Delinquent federal student loans are exempt from both SOL and credit report exclusion provisions under the FCRA, and thus can both remain in your credit report and be subject to civil action until paid. I would consult an attormey.
I have seen some other posts where people have posted about their federal student loans and they weren't that difficult sounding. Is there really no way to fight it, like first time forgiveness or someting if I have had a clean record for years now. What about the fact that they reported my delinquency after 30 days of being late (it might have been even less)? I have read that usually these are reported after 90 days. They reported it only to one credit bureau, but sadly it was the only one that matters, Experian.
