Trojan Professional Service Medical Collection

Hi All,

 

This company reported a collection to the credit bureaus. I have already paid the dentists office directly and I have the canceled check showing that it was cashed by the dentists office.

 

Maybe the dentist did not convey to Trojan that it's been paid. I want this removed. Is it better to dispute it with the CB, or contact the dentists office, or speak with Trojan directly? I'm not sure of the best approach. Any advice would be helpful.

Hello,

 

It's reporting open and there is a balance. The balance was completely paid though. It was paid late, but it's paid in full.

Once a collection has reported, the debt collector is under no obligation/requirment to delete the reported collection based on payment of the debt, regardless of to whom the debt is paid.

The CRA reporting manual clearly instructs debt collectors not to delete their reported collection based on payment of the debt.

The debt collector is required, after notification from the creditor that the debt has been discharged, to close their collection and update the debt balance to $0.

 

You can dispute the lack of update to show paid, $0 balance, but deletion of the entire collection is not required.

A dispute filed with the CRA would be requesting that they delete for a reason directly contrary to their reporting policy.

 

The proper process to pursue removal of the collection is to contact the debt collector and request that they grant a good-will deletion of their reporting.

One more question, is it best to request the goodwill deletion in writing or just call?  I'll search for some sample letters. I'm not really sure of what to say for the best results.
