First time posting but I've been following the board for a while. Here's my dilemma, I have a Wells Fargo Dealer Service Charge off for $900 which the freakin GAP Insurance company did not pay when my car was totaled back in Jan. 2013> Progressive $10K and the GAP Insurance was supposed to cover the other $2K, instead they only paid like $1500. I spoke with WFDS today and they said it could be from a missed payments or a few other conditions. My question is has anyone ever dealt with this before? If so, how? WFDS said I could send payments in and once it's paid off it will show as paid in full. I do not want the charge off showing on my account, anyone had any luck with a PFD with WFDS? A charge off is an accounting measure predicated on their determination that a delinquent debt is not likely to be paid.
To REQUIRE deletion of a reported CO thus requires a showing of error, either as to whether the account was actually delinquent, or as to whether their detetmination that the consumer was unlkely to pay is supportable.
Otherwise, deltion of the reporting of a CO is totally discretionary on their part.
Payment of the debt does not negate their having taken that prior accounting measure, and thus is not basis for compelling deletion of the CO.
PFD is the apparent option.
Until the debt has been satisfied, they can always refer to a debt collector, which could result in a collextion also reporting.
Thus, if they wont do a PFD, it may be beneficial to pay and then pursue requests for GW deletion.
Thanks for the response, I will just split it up into two payments and send a GW letter. I moved around that same time so I never received any mail about the unpaid balance and I haven't received anything from a CA.
