What should I do about collection notice?? Dynamic recovery solutions! Help

I received a letter from Dynamic Recovery Solutions dated 1/4/19. It claims  I owe money on an emergency physician bill from 07/19/2014 in the amount of 750 but will settle for 250ish. This debt was sent to collections and I believe was on my report under another CA at one time because I did not really care about disputing. I am worried this debt will eventually show up on my credit reports. Basically the 1st CA sold it to another. I really don't know what to do. I think the Statute of Limitations in FL is 5 years for medical stuff. Should I request validation? Settle? Bury my head under ground? I Is 750 really worth getting a judgment over? I feel like court costs are higher than that. To add to this the very next day I get a letter from them requesting payment on another old debt,  this one a cell bill that is out of the SOL and they claim this at the bottom of the letter this and say they cannot sue and will not report to credit bureaus. It also says at the top that they did not receive a response from their previous letter that NEVER CAME.  I can afford the settlement and the full price for that matter but don't want to restart clocks on SOL or have this GO ON MY CREDIT REPORT Smiley Sad. Also worried they may start digging for other old bones if they see how effective their coolection tactic worked on this account. Any help would be great!!!!!

If its yours make a deal with the current collector to settle it in exchange for it not being reported. I will also give you the typical steps for medicals that are reporting to your CR

 

For unpaid medical debt that is reporting on your CR:

1. Call the OC and see if insurance can be billed, if not then
2. see if you qualify for Charity Care, if not then
3.  ask that they recall the collection in exchange for full payment
4. Send the reporting CA a PFD offer
5. Google the HIPAA Process and contact its creator for help

Always, always request verification of any collection even if you think it’s past SOL.

When I applied for a mortgage last year, I got 3 of these from random collection agencies. I wrote right on the bill, “I dispute this bill and please send verification that I owe it.” I also attached a formal letter to the bill repeating the same thing and stated that I would sue them if an erroneous collection or a debt that expired due to SOL and sent the letter Certified-Return Receipt Requested.

Needless to say, I never heard from them again nor was a collection placed on any of my reports.

So nope, do not bury your head in the sand. Be proactive.

Thank you both for replying. My main concerns are with things I have heard with the dispute process. I worry they will just send me the minimum requirements then put the collection on my credit report. Honestly that’s my only worry. If I was to settle. I just want to know how to go about telling them terms without accidentally resetting the SOL. How do I say I’ll pay this if you are willing to not report and take settlement amount as paid in full without basically saying the debt is mine? It feels like your screwed no matter what.

A request for debt validation does not impose any requirement that the debt collector respond.  If timely (meaning it is sent within the 30-day period after a dunning notice), a DV imposes a cease collection bar, which remains in place until such time as they choose to send validation.

In the interim, and prior credit reporting is not required to be deleted.

You can thus be in limbo for an extended time if you file a debt validation request.

A DV is not always the best step.

 

In the interim, the debt collector is barred from any negotiations, which includes response to any PFD offer.

 

It is thus not always prudent to send a DV request, particularly if the debt is valid and you wish to negotiate a settlement for less, a pay for deletion, or a pay for not reporting offer.

 

If you wish to pay, it may be preferable to forgo a debt validation request, and contact them with a pay for not reporting offer.

I actually did send a DV letter. Only because I have had this debt removed from my report before when disputed with CRA. The worst they can do is validate it and I have to pay 717 instead of 250 if unwilling to settle. I talked to an attorney friend this morning and they said it’s highly unlikely that a suit would ever come of a 700 collection. Also, the SOL expires in July this year. So I’m sitting here waiting hoping they can’t prove, or it takes long enough to expire the SOL, or they just don’t care enough to take any further action on a small collection. I was very polite and non threatening in the letter but did get the point across. The debt has been sold 2x and I’m hoping that will help the odds of them not validating. If all fails I will pay the debt to keep it off/get it off my report. Answer this for me... if the collection is in the validation process...can they at that time report to the bureaus? Wouldn’t that be considered collection activity and be unlawful? Also this other letter that says it is out of SOL and the creditor will not file with credit agency.... should I just take no action and ignore it? They basically are saying they are there to help me clear it. The letter said nothing about 30 days to dispute or anything of that sort. They are not blowing my phone up about either account which I appreciate.

I have those clowns calling me once or twice a day on behalf of Jefferson Capital in regards to a 199 dollar phone bill i defaulted on in 2013. Dynamic isn't reporting on my CR's but JCS is every month. I filed a complaint on BBB website yesterday because i heard JCS removes the tradeline in most cases. In your case keep the letter where the SOL has expired for a suit and credit reporting timeframe and yes take no action or admit it's even your debt. I saw that DRS is responsive on the BBB website, so if they do report the zombie debt then file a complaint. That should take care of that.I'm pretty sure i saw online somewhere that DRS is being sued right now so i doubt they'll do anything to violate your rights. keep us posted with your outcome.

I sure will. I hope I put the demons to bed by sending that letter. We shall see. I hope you are able to get these people off your back Firefighter1.   It's crazy how these people find zombie debts floating around and are willing to pay anything for them. Seems like a waste of money on their part. I know they buy them cheap, but still. Like others have said I feel that they get tipped off somehow when you open new accounts. Like creditInspired said he receieved all his letters after he opened a mortgage. I just had a credit card spree... I wonder if that put me on their radar.... who knows!
