Williams & Fudge Collection

Hello Everyone,

 

I had bank of america student's loan which was defaulted and it went to Williams & Fudge collection agency. I have been paying the monthly payments for past 2 years. I checked my credit today and it says that the "bank of america" loan is closed and "late". I don't see any accounts for Williams & Fudge. How is making the payment helping my credit score if the bank of america is already closed as "late"? I called Williams & Fudge and they said that they don't report anything to the credit and couldn't provide any information. Should I call bank of america and ask them to reopen the account and make sure that the payments are being posted? Any help will be appreciated.

Did the debt collector purchase the loan, or are they only an assigned collection agent?

 

The OC account will remain closed and late (in a derogatory status) until the debt is fully paid.

If the OC has sold the debt, the current balance should have been updated to $0 at time of the sale.

In that event, there would be no need for any additional updates by the OC, and since the debt collector is not reporting, your credit report will not show the amount of remaining debt.

 

Howeer, if the OC still owns the debt, then techincally they are required to promptly update the remaining balance as it is reduced.  FCRA 623(a)(2).

It is not uncommon for the creditor to be lazy in that regard and not update when each payment is made, usually because they are not notified monthly by their agent of ongoing payment status.  Not a huge deal, but they are technically required to promtply update so as to maintain the current accuracy of each item of information they have reported.  They are likely waiting until the total debt is paid to do balance updates.

 

Do you have a substantive need for your report to show the ongoing, updated balance, such as being in a new credit application process?

No, it's not needed but I wanted to find out if bank of america reports the payments, will it improve my credit on monthly basis? The loan is still with BoA but Williams & Fudge is collecting it.

It wont affect your score, but it will advise others who may pull your report that you are paying on the debt, and that the balance is now lower.

 

If you dont anticipate others reviewing your credit report, it is a bit academic.

However, if applying for new credit, it might be beneficial to get continued updates.
