I went online to econsumer.equifax.com to view my Equifax Credit Report. The Report is as of: 07/13/2015.
Midland Fundaing is listed under account category "Other Accounts" subheaded "Closed Accounts".
Both Midland accounts show a balance and a past due amount.
Midland is NOT listed under "Collections" at all.

 

**Edit: I should have also noted that it also states "Type of Account : Open"  and "Type of Loan: Factoring Company Account (debt buyer)" for both Midland accounts.

 

With this information, should I file with CFBP??  

 

I am just scared / nervous since I recently paid off a consent judgment to a law firm / Midland for a Chase account which was done by saying breach of contract and account stated.
"The Alabama statute of limitations for credit cards and similar debts is three years which is an “open account” as there was no payment schedule with your credit card — you just charge on it and then make at least the minimum payment. The statute is six years under a stated account (or account stated)."
So saying whether or not the 2 Midland accounts are within or out of statute of limitations is tricky.
Midland has had the Target account since July 2012 & equifax lists date of 1st delinquency as 05/2010.
Midland has had the GE/AE account since May 2012 & equifax lists date of 1st delinquency as 06/2010.
So I am unsure of how to try to handle those in fear of them using account stated against me again...& now I wonder since that was a Chase account, if I could have been part of the whole 'Chase refunds millions' in settlement thing- og well, totally different issue....

pnrbma, Midland is the same on mine, lists under closed account instead of collections and shows a balance.

Is the problem Smiley Happy.......Caedus - I shared a pm with the sample EQ report showing how a collection should look in EQ......if it does not, I would start disputing...........................

what should be the very first dispute? I ask, as I am trying to be overly cautious as to not mess up anymore than I already have. expecially since Midland has "sued" me before.

Yes should the dispute start with Equifax and then pull in CFPB if response not acceptable? I have a DV open with Midland right now should I wait for a response from that first?

Dispute with equifax first.....certified mail and keep ur records.......

Chances are they will respond with a response that says it is yours...not that the data is accurately stored in their application./systems.

Ask for the method of verification including the name, address, phone etc that they verified this with.

Then...Cfbp...in detail....they/EQ will most likely respond in the same manner the fiest or many times.......I also actually went and filed a dispute with AALLC through the CFBP..and we had been to court, with the same verbiage...I pasted their reply previously.....I finally landed in the offices that handled the cfbp complaints and they sent deletions to them all that same day.

Equifax has this stored as a Credit Grantor, locked the account or prevented it from being deleted on July 7th.....that too was used against them in the complaint....

I actually had no fear left....and still don't cause I want the world ro know that this is going on ri g t below our noses...it kills your scores, and they know it.

Ok so can someone tell me why our mortgage with Midland is showing closed/derog and $0 balance on pur credit reports if we kept our home during our chapter 7 bk? All payments are up to date and never late, don't understand it reporting as a closed account?

 

I am also seeing accounts showing open and on payment plan even though the amount is showing $0 and it should also say Chapt 7 which is doesn't.
