fishy collection letter??

I pulled my hubby's credit reports a few months back, they were clean.  Yesterday in the mail he received a letter from NCO Financial Systems (in PA) stating, "As you are now aware, the above named creditor has placed you account with us for collection.  PLease pay this balance or contact us to make appropriate payment arrangements..."  The "account" is an AT&T account from over 7 years ago, that was originally placed with a CA in TX.  Hubby thinks we paid it (I cant remember), but I do know that we never received a notice stating that the account was being placed with them giving us 30 days to dispute.  How do I handle this? I believe the SOL in WA state is 6 years.  I am willing to pay the $58.04 if its legit, but I am questioning if it is.

I got a letter from NCO last summer on an account that was charged off almost 10 years ago offering me a settlement.  I was positive the SOL had expired so I sent them a letter disputing the validity of the debt and also addressed the SOL issue.  In the letter, I told them "not only do I dispute the validity of this debt, I have also checked with my State Attorney General's Office and verified the Statute of Limitations for enforcing this type of debt through the courts in Illinois has expired.

 

This letter is your formal notification that I consider this matter closed and demand that you, or anyone affiliated with your company, stop contacting me regarding this or any other matter except to advise me your debt collection efforts are being terminated or that you or the specific creditor are taking specific actions allowed by the FDCPA or my state laws."

 

 

 

I closed with a paragraph indicating any contact not in accordance with the FDCPA is a serious violation of the law and that I would report it to my State Attorney General and the Federal Trade Commission. 

 

I go a letter back in two weeks saying the matter was closed and that nothing had been reported to any of the credit bureaus.  I think you're right that they are simply fishingSmiley Very Happy
