And the call they are speaking of is when i called the hospital to see if they could lower the bill, since the collection agecny sent a letter stating they wanted full payment, because they where going to take further action--

After you sent the pre-HIPAA dispute letter, did the CA ever validate the debt? If not, the HIPAA letter to the OC shouldn't have been sent. I just noticed that after reading over this thread again. Your situation is going to require a special letter, but I'm not sure who you should send this letter to. I'm inclined to lean on the OC because you paid them, but I'm not entirely sure. Let me get back with you.

I sent pre hippa letter to TRANSunion---like it says in step3---It came back as "New information below" for this account .....

No, that's not what I'm asking. After you sent the pre-HIPAA letter, did the CA send you a complete and accurate validation of the debt. According to you, the CA just sent you a letter informing you that the hospital was willing to settle for less. This does not constitute a validation of the debt by the CA.

 

If the CA does not validate, the OC letter should not be sent. Why? You have not proven a business relationship exists between the OC and the CA. The more I think about this, the more I think you will need to focus on the OC because you paid them. In meantime, call the OC and tell them your collection is still marked as unpaid. Do not discuss anything else with them. Don't even whisper the acronym HIPAA.

Will do this first thing tomorrow----Am I looking for them to say anything specific about it? They may just tell  me it takes a certain amount of time..

Its appears that it has been more than a month since they cashed your check. Your reported should've been updated by now.

The letter said it was due by March 9,2009....they didnt recieve the check until Feb24th according to the cmrr, and took another week to cash it. So it hast been a month yet...

Ok! If the collection is not marked as paid by April 7th, call the OC and let them know its still reporting as unpaid.
