Late Payments (last 7 years):
|
THIS INFORMATION IS FROM ELIMINATEIDTHEFT.COM - The concern is the reported info on Transunion of 7/2011. Can I do anything?
Your concern is simply the date this was updated? Doesn't indicate any type of ID theft or anything else for that matters. Creditors occasionally will update old items... usually a result of a dispute, but not always.
Yes that was my concern,thanks.
I just found an old credit report. Seems ol' Nissan likes to update this account every month. Weirdos.
I would not be too concerned. Parties quite often report to a CRA long after the original event occured, and this does not necessarily mean that anything new was reported. Reporting is not limited only to "updates," but rather can simply be the continued reporting of the same information.
If you dont know the subject or substance of their reporting on 7/2011, you can write the CRA and get the information. Just send a request to the CRA under FCRA 609(a)(1) requesting the information, along with the procesing fee of $11.00 for such requests.
Thank you for your info RobertEG - now if you can tell me when to send the 11 bucks for other things I'll be set to go - should I pretty much send the 11 bucks when I want them to do something or provide me with any info at all?
FCRA 609(a)(1) is an all-encompassing statute. It states that a CRA shall provide "all information in the consumer's file at the time of the request..."
Of course, this is not taken literally in the practical sense, as "all information in the consumer's file" includes tons and tons of information that you are probably not interested in, and much of which is stored in obtuse Metro 2 coding that only the CRAs understand.
So it is, in practice, "limited" only to the specific information that you request in your letter. Clearly identify that information. Also include photcopies of proof of your identity.
Requests under section 609(a) require payment of a processing fee. That amount of that fee is updated periodically, and was updated by the FTC in January of this year to $11.00. Each request should include attached payment to the CRA in that amount. The request is filled directly by the CRA, so you dont have to beg creditors and debt collectors for records that you need.
Also, in your section 609(a)(1) request, you can additionally request the source of the information by additional request under section 609(a)(2). For example, if you want to see who actually reported certain information, such as a DOFD or a legal judgment, you can additionally do that. The $11.00 fee, pursuant to section 612(f)(1), is per request, so if you make all requests in one letter, the single fee would cover it.
OK. This information is golden. THANK YOU!!!!!
Why is it that people don't know you have to pay a fee to get info from the CRA's? You are the only person who has ever mentioned this. I'm assuming a regular dispute does not require a fee, but a dispute where you are wanting to know how they got that info would? Sorry, you don't have to re-answer, I think I'm just talking to myself as I do around here a lot
The statute specifically stipulates that disputes must be reinvestigated free of charge by the CRAs. See section 611(A)(1)(A).
As for services that require a fee, they are specifically outlined in section 612(f)(1). Section 609 requests are specifically identified.
