I HATE AFNI !!!

Bare with me as smoke is coming out of my ears as I write this..
 
AFNI posted a collection on my report on behalf of Sprint in July 2007. Didn't check reports until September 07, saw the collection and disputed as not mine.  Of course, it came back verified, so sent a DV letter 9/28/07 and as soon as they received it I disputed with the CRAs, came back verified and they reported again on 10/7/07. Sent a follow up DV letter 10/24/07 then disputed after they received it, they verified AGAIN on 11/2/07. Not to mention the fact that they are not licensed in VA to conduct business. Per VA State Corporation Commission any LLC or corporation conducting business in VA needs to be licensed to do so, and according to the clerk's office, they are not licensed.  Complained to BBB on 11/2/07, and I got a letter from BBB today saying that AFNI has requested validation items from Sprint and will forward to me. Did I already say they verified with CRA before sending me validation info? Here is the kicker.. I called Sprint this morning, because if it is mine I will pay I'm just upset about the way they are going about this, and Sprint says they have not contacted AFNI to collect this debt.  Does that make sense???  Sent off complaint to AG and FTC this morning,.. I'm so upset I could cry.
 
Other than complaning, does anyone know what else I can do?  I am planning on paying Sprint (because I guess I DID owe them money, but you go through a divorce right after having a baby and then tell me what does and doesn't slip your mind), but would like to take them to court.  Would I be entitled to monetary damages?  Has anyone here had/heard of any experiences with going this route with them?

Definitely would be wise to consult with a consumer affairs lawyer.
 
This is crazy stuff!  So Sprint says AFNI is not collecting... could it be resold?
 
I agree on paying Sprint and would PFD ASAP.  It's sounding like at the end of the day, if it is worth your time.... AFNI will be paying you back for your Sprint bill.  Smiley Wink

BTW check your state debt collecting SOL before PFD.

I dont think a CA can sell a debt to another (read AFNI) if Sprint never actually sold it, the other CA (can't remember the name right now) is only collecting on their behalf.  Or can they?
 
I will be paying Sprint regardless as I don't want this following me for the next 6 years (default was 06), but in no way, shape or form do I want AFNI to benefit from this in the way of PFD (I'd rather pay Sprint) or anything else. I'll take this as far as I can. I'd rather have them spend money and go to court than to let them off the hook! I'm sure if they're doing it to me then there a million other people out there going through the same thing and it just isn't right.

So I got a letter in the mail yesterday from AFNI saying....
 
We have received your dispute but we are unable to confirm at this time.  You have provided insufficient information to substantiate your claim.  We will complete our investigation within 30 days of receipt of the following information:
 
- The specific information you dispute
- An explanation of the basis if your dispute
- All supporting documentation to substantiate your claim to included photocopy of driver's license, copy of passport, proof of residency, etc.
 
This is an attempt to collect a debt blah blah blah. When I sent out the DV letters I included the account number that they are reporting to the credit bureau.  And they can't confirm?
 
What should I do now?  I've read and read on this forum but can't seem to find the answer, so I apologize in advance if this has been answered already. I am planning on purchasing a house next year and this situation has really been getting me down.

First, I know this is really upsetting but try to take a breath and remember that this can be solved w/ patience as you are already displaying. I know it hurts personally.
 
Contact Sprint right now and negotiate a PFD as hard as you can today. Persuade them to agree. Then CMRRR the cashiers check off immediatly and ask them to call you back as soon as it posts or to notify you in writing if they can. Try to solve this w/ Sprint since they say it hasn't been sold.
 
Then- once paid w/ Sprint go after AFNI knowing you have back up proof that they have nothing to collect.

I hate AFNI also.  I sent numerous letters certified to no avail.  I have been fighting with them for over a year and eventually decided court was my best option.  I am currently suing them in small claims court for the exact amount they say I owe them.  I know I will never receive a dime from these idiots but I should receive a court order to send the 3 credit bureau's to make them remove this from my reports.  They should receive the notice any day now and will have 10 calendar days to respond.  I assume they will not in the alotted time which should allow me to go in front of a judge and receive a defaulted judgement.  I sent these people numerous letters during the last 12 to 14 months and if they did respond at all if would take at least 60 days.  They would never respond with any of the info that was requested because it is not mine.  Good luck with these people be patient and persistent.

Wow, over a year?  Congrats on taking them to court, let me know how that goes! I've already contacted a lawyer who says I can sue them plus the 3 credit bureaus, but I'm waiting till I pay it off to continue with that. In the end, I know it will all work out as I have heard nothing but bad news about this CA, it's just getting to the end that is driving me nuts.
