I have read the Hippa process thread and done:
1. 3/7/09 - opted out via "the website"
2. 3/7/09 - mailed opt out letters to all of my current creditors in good standing
3. 3/10/09 - mailed pre hippa letters to the 3 CRAs
While waiting, received a collection letter for a medical collection that is not currently reporting and therefore was not a part of the pre hippa letters. What do I do?
1. The OC is not reporting this
2. The CA is not reporting this
Do I pay, and if so, do I try to get something in writing from the CA that they will not report?
Ignore the CA and make payment to the OC using the restrictive endoresment now!!! What letter??? did it come CMRRR.
A CA can not report until the mail you a letter.
1. The letter came regular mail "... Unless you notify within 30 days that you dispute we will assume this debt is valid..."
2. I contacted the OC by phone, gave them the account number for the bill and was told that the debt had already been transferred to CA and that I now had to deal with CA.
3. If it turns out the answer is to still use a restictive endorsement, is there some sample text of one?
If a letter is not sent CMRRR then there is no proof that it was sent!
Restrictive endorsement is simple...........Payee: Full name of OC. On the back of check: For deposit only into the account of FULL name of the payee
Just to be sure I understand, even though the original creditor told me to only deal with collection agency for this debt via phone:
1. Ignore OC comments
2. Ignore CA letter'
3. Mail payment in full with restrictive endorsement to OC
