I really need some help.
I have an account with GMAC with a DOFD April 2007. I have filed disputes and spoken to CSRs and the Office of Consumer Affairs and gotten the same response. They claim that the DLA (January 2010 - the date of the charge off) is the date used to determine the date the item falls off the credit report. According to the person I spoke with at the Office of Consumer Affairs at Equifax the legal department gave her this information. I have sent and quoted to them FCRA 605(c)(1) including the footnote and she said there was nothing else she could do.
Transunion has deleted, Experian has the fall off date as 2/2014 (in dispute with them because of the NY 5 year rule). I need this item removed from my report. Thanks to this great forum I have gained nearly 100 points on both EQ and TU.
I know some will tell me to get an attorney but I am trying to save for my down payment and just can't afford that route. Does anyone have any contacts at EQ they can PM me or had a similiar situation they got resolved.
