Hello I had a collection removed by all three CB's from NCO and the original creditor was Bank Of America for an charged off bank checking account. The NCO collection was just removed last month (FEB).
This account charged of in Sept 07 and is still in SOL. I just recieved a letter from another collection agency (FBCS) dated March 5th 09 collecting on this same account that was removed from my reports can they put this back on my credit report? Thank you for any info
When you say you had it removed, how?
Until it is past CRTP, a CA can report it as long as they report accurately.
I sent them a DV and it was removed from all three I never recieved any letter from them or anything. This was only about 2-3 weeks ago. And now its with another company. Well at least I think so since they just sent me a letter.
Our Client, BANK OF AMERICA, has authorized us to accept a 50% discount off your outstanding balance to settle the account in full. then it goes in to details about the settlement , but it doesn't say anything about it being reported as paid in full. Then at the bottom it has the normal this is aan attempt to collect a debt and you have 30 day to dispute and if I do they'll obtain verfication and etc....
I was wondering if you think it was sold from NCO or did NCO sent it back to BOA and then they sent it to theis company. The company is called FBCS INC. As of right now ts not showing on any reports and nor have they pulled my file. I was wondering if it can be re-inserted by another CA or not? Thank you for your response.
This is the same exact problem that I am having. This BOA mess is wreaking havoc on my credit. I can't even figure out who owns the stupid account. (FOUR agencies)
I have notices from ERS, Accounts Recieveable Management (on credit report), NCO (on credit report) and now FBCS! All for different amounts!
FBCS suddenly started calling (letter on March 5) as soon as I disputed NCO for duplicate listings on my reports. I am going to send a DV letter to FBCS today.
Is there any way to get the original account information from BOA to verify what is truly owed? Has anyone had success with something like this?

I would DV the CA that is contacting you now. It is possible that NCO had long gotten rid of the account before you DV'd.
If they validate and you can take the offer, I would negotiate in writing a pay for not reporting. Which is like a PFD, except they aren't reporting, so there is nothing to delete.

You can try calling.
Also, when you DV, you need to request a copy of the debt or judgment under FDCPA 809. Per the FTC, this should come directly from the OC at the time of request, a copy of what the CA already has or a computer generate printout from the CA does not fulfill this requirement.
