If they update the account it may make the account appear as a recent charge-off which would ding your FICO score unfortunately
Unless I'm misunderstanding your situation, I would say enjoy your new car and otherwise do nothing. Let the old car stay parked in your driveway and forget about it. Let the 5 year 9 month old CO age off your report in 15 months.
Negotiating with Cap 1 at this point is more likely to backfire on you than to help you, IMO.
In think in most states, you're outside the SOL. But if not, are they really going to sue you after lending you tens of thousands for a new car? Seems unlikely (but not impossible, I suppose).
