Hello everyone! I filed for a Chapter 7 a couple of months ago and was going through some of my papers today and found some credit accounts that I had totally forgotten about.
My question is since 3 or 4 of these accounts are with Synchrony... Walmart, Lowes, etc. Synchrony is listed on my BK already for some other accounts but not the ones I listed above. Do I need to go back and specifically add Walmart, Lowes and the others or will Synchrony automatically link all of these accounts together since they already know that I have filed?
It would be great if I did not have to add these accounts individually because my attorney is going to charge me $150 per creditor that they have to add.
However, I want to do the right thing so I do not mess up and later get stuck with these bills and dings on my credit after BK. Help please! Thanks 🙏
Honestly I would add all of them separately. I had 2 different Amex cards and had a few different Chase cards. I also had a few Synchrony cards too. For Amex, they charged off my debt (both cards) almost immediately after I told them a few months ago I was planning to file. When I got the notices from the collection company, I got 2 separate notices - one for each Amex card - and they had separate account numbers issued for each one. Ask your attorney though to be completely sure.
I would add them all. You don't want to miss them. Your attorney is going to charge you $150 per creditor you have to add? That seems excessive.
Do you owe them money? If not, I wouldn't worry about it because there's nothing to miss getting discharged. I wouldn't think you'd forget them if you owe them.
Theres a few states that wont cover the debt owed if you forgot. The good news is that, in most states, if you forget to list a debt by mistake and there’s no property to give to creditors in your Chapter 7 case, the forgotten debt is erased anyway. The reasoning is that, even if you had properly listed the debt, there would have been no funds available to pay the debt. It’s a “no harm, no foul” rule. Send the creditors a copy of your filing document and DC papers to their BK Dept.
My attorney was very expensive and I initially did not want to go with him since my filing was very straight forward. I had several Comenity accounts and realized that a couple of them were not individually listed, Lazyboy was one of them and I owed them roughly $2,000. I do not want Comenity to come after me once I am discharged.
Hey thanks for getting back to me! Take care and stay safe!
Hello and thanks for responding to me! Yes I owe each one at least $2,000. I almost feel like it's worth paying my overpriced attorney the extra $150 per creditor that I have to add.
Hi there, thanks for getting back to me. Do you know if Virginia is one of those states that is forgiving if you forgot to add a creditor? Thanks again!
@creditlady43Your fine. Its Maine, Massachusetts, New Hampshire, Puerto Rico, and Rhode Island that wont let the debt be DC'ed if it wasnt filed in the first place.
