Once a BK is discharged, all accounts that were included in the BK should then be listed as IIB (if all accounts are reporting correctly). My question is how long will those accounts be on the CRs? Is the DOFD the determining factor for each account?
I’m trying to get all my ducks in a row for my upcoming BK discharge, but there is one account that recently changed the DOFD to 1-1/2 yrs. later than was reported on previous CRs and was well into the BK at that time. This was the outcome in response to my asking Experian to investigate/update the charge-off that was being reported. I’ve disputed this account several times over the past years but they continue to come back reported correct. I’m wondering if the fact that several months after the BK was filed, this creditor sold the account which in turn their records show this as a charge-off status vs. a BK. In any case, how can I have the DOFD corrected if the creditor now states this bogus date? (And why would they state this incorrect date?)
I spoke with an Experian rep. this morning who instructed me to send them a copy of my BK with the listed creditors. This will update all accounts reporting as IIB even though the subject creditor continues to show charge-off. My concern is the DOFD discrepency which Experian cannot verify except thru the creditor.
If you have the older CR you're in good shape to prove the re-aging, which is potentially both a FDCPA and FCRA violation. If you show the proof to the CRA and they refuse to fix it you may have a claim against them as well.
I have a freeannualreport.com which was accessed June 2011 stating the correct DOFD. It is the one supplied by Trans Union. Will Experian will accept this?
The Experian CR pulled from annualreport.com website does not state a valid drop-off date but Trans Union (from the same website) does. Will Experian accept a copy of this report?
