Thats usually decided when you file to make it easier for the trustee handling your case. And 65% of lenders usually make you reaffirm. If your upside down by a lot. Pass. Pay and drive and it wont report to the CRA's. Turn it in when you want and walk away. Reaffirmed and it will report to the CRA's and you cant turn in the keys and walk away. Thats your 2 options.
