I filed Chapter 7 in May 2018. It was discharged in August 2018. I had several Capital One cards discharged in that bankruptcy and obviously lost them all. A year after discharge, they allowed accepted me for a couple new cards which I have been resposible with and kept up on. Credit limits are still low.
My house was reaffirmed in my Chapter 7 which I know is controversial. My lawyer reccommended it and it was the only thing I had a good history on so I did it. Fast forward to September 2019 and I left my job due to health issues. My last house payment was made in October 2019. Now the house is in default and they are starting foreclosure. I called a different bankruptcy lawyer to see if Chapter 13 was an option to save the house and she said yes.
From what I have read, it means I will not be able to have any debt discharged in it but that's fine because I don't expect that. All I want is to be able to catch my house up. It is literally the cheapest place to live around here and it is set up for my handicapped mother. I really can't lose it.
Has anyone been in this situation? I am also wondering if I will be be allowed to keep my Capital One cards in the bankruptcy or if they are a company who automatically closes them when bankruptcy is file? There are low balances on each and there is no possibility of them being discharged and I'd really like to not screw Capital One again.
Get more opinions. I thought a CH13 after a 7 required 2 years from discharge. I may be wrong though.
ETA: After a quick Google search I probably am wrong.
Yeah. I read 4 years is required to discharge debts but you can file Chapter 13 immediately after 7 if you do not need to discharge any debts. Informally called "Chapter 20". Some people PLAN it this way which is insane to me. When I filed 7, the plan certainly wasn't for any more bankruptcies period. My health had other plans.
I'm really sorry you're going through this.
It's not fair that people should go bankrupt because of a reverse in their health.
