I'm reviewing our credit reports in anticipation of our upcoming discharge (should be within 4-6 weeks) and noticed one creditor that is not reporting the debt to be part of our BK13. They are reporting a past due amount other than $0 and show lates of 30/60/90 and then CO. The account was current with no lates all the way up until the filing date. It's as if they are ignoring the BK altogether. Should I take action to get this rectified now, or wait and see how it's reported after the discharge is complete?
So, I just got done with an email exchange with my attorney. He states this account was not included in the BK filing. I don't understand how we missed reporting it to him in the first place. We weren't late on the account, so it's not like it was out of sight out of mind. Plus, we never received any kind of collections requests from them. I'll need to check my paperwork that we submitted to him 5 years ago, to make sure it wasn't his oversight.
This happened to me, although, it was the attorney's mistake. He had omitted them when we had put them on our list of creditors. We notified him they were missing when we reviewed the paperwork and he still didn't include them.
We contacted the company directly and the reported with the bankruptcy and removed the collection account as well.
I have a suspicion that it was our attorney's mistake as well. But I know that it's not going to make a difference whose fault it is at this point. I'll be writing a GW letter explaining what happened to the creditor. Our BK13 was a 100% repayment plan at 5% interest for our unsecured debts. So we were under the impression that this and all other unsecured debts were being paid back and with interest. My heart sank to find out this news today. Hopefully I can convey that sentiment appropriately and they will be willing to delete the TL from the CRs. If not, it scheduled to drop 7/2017. But I'd really like this off my CR's sooner.

So I was prepared to send a GW ltr, but upon looking into our files I found that this debt was on our petition. Although, I don't see it on the disbursement list, so I have an inquiry out to my attorney about that. Hopefully he'll do more due diligence with this question than my last one. So looks like I'm disputing this TL. Thanks.
