HSBC and Chapter 7 BK - please help

Hello,

I have a discharged Chapter 7 BK and am having difficulty with HSBC credit card account.

 

I am still receiving statements dispite numerous attempts at communication - when I call I either get diconnected or are put on hold for 30-45 minutes at a time, I have sent copies of letters from my attorney to three different addresses informing HSBC of my BK (my attonery has tried to contact them numerous times as well with the same outcomes) and are now getting letters indicating that they are forwarding my account to collection services.  The account is also in default on my credit score which I am trying to rebuild.

 

Does anyone have any advice or experience with HSBC that would help?  Does anyone have any contact information that they could share?

If the HSBC account was included in your bankruptcy (schedule of creditors), a consumer attorney who practices in FCRA/FDCPA would gladly take this case.  It appears as if they are in violation here.

 

It may be a case of they did not get your notice of filing and disharge order - but, that may be irrelevent here.

 

Did you file with an attorney or do so pro se?

Hi - thank you for your reply.

 

The account was included in my schedule of creditors - I sent the notification to the addresses on my statement as well as an address that I found on my credit report.

 

We filed with an attornery but they have indicated that they have never dealt with this scearnio before.

Then look for a Consumer attorney in your area that deals with this.

 

They will offer a free consult - and if you have proof you sent a notice to them (certified mail) and they haven't corrected it - then you get 1000 dollars plus your attorney's fees paid by them - which is why many of these attorneys will not charge you a dime - because the cases are usually pretty cut and dry.

You can also get the trustee involved if they are still sending you statements....
