Hi All,
I checked pacer today because my attorney refuses to return my emails and this was on it:
Order of Discharge12/15IT IS ORDERED: A discharge under 11 U.S.C. § 727 is granted to
This order does not close or dismiss the case, and it does not determine how much money, if any, the trustee will pay creditors
It is signed by the Judge for yesterday date, does this mean my case will soon update as discharged and dismissed or is there another step.
It says nothing about my Rideshare LLC or the inventory from the online business or my taxes and have not recived any contact from the trustee about any of these items.
Thank you for any information from the forum.
I think I remember that mine was "discharged" before it was "closed" later on Pacer. If it has been discharged, that is a legal term, AFAIK, and it means the judge signed the order to discharge your debts. The case is closed later. Again, there are folks here who know far more than I do..
I am only speaking from personal experience so take it with a grain of salt. However, I had an asset chapter 7 and the case was discharged before the trustee seized all eligible assets (in my case stock from an ESPP I was unable to get rid of prior to filing). It was not closed until after she had seized and distributed all assets which took a couple of months after the discharge date.
Hi @tjtay89,
My question to you is were you notified at any point prior that the trustee wanted the assets. I have not ever been notified and my case was filed as a no assets case from the start. My attorney told me to not sell any of it but again no notice of any interest up to this point. FYI it was only 3k of inventory on a 135k filing and no objections.Thank you
Hi @Back2Reality
Thank you, question what was the time frame for it being closed for you. again I have tried to contact my attorney but nothing lol, what you want for 2k i guess.
We went in knowing that the trustee was going to want assets, so I was never in your specific situation as it was always considered and approached as an asset case.
Hi @tjtay89
Ah, I thought thats how mine was going to be but it was filed as a no asset case from the start, maybe thats why i have heard nothing. My attorney was not clear on this matter but I am sad she said to close the online business if they were not really going to come after the assets. Thank you
Hi Everyone,
Just wanted to take a moment to thank everyone for giving me info when asked. It looks like I do not need the case closed like I thought, the discharge has already updated on Experian , the other 2 not yet but it has only been sine the 18th that the judge ordered a discharge. I am hoping that once transunion reports it that Cap1 Will take the car loan back over and get that reported.
The accounts listed are all at 0 and IIB so i do not have to worry about that, just going to wait till all 3 update then go from there. Thanks again everyone.
Congrats @Anonymous . Its the stress of waiting and your mind is going thru all kinds of emotions and what if's. Well enjoy the financial freedom now!
Did you do a ride through with Capitol One? If yes how did you pay your bill during the automatic stay?
