Hello all,
i filed for chapter 7 bankruptcy and in the process of doing so I burned some major players. AMEX, NFCU, PENFED, and Discover just to name a few. I know from reading the forums that I will not get back in with any of them for a long time, if ever, unless i pay in full and that's not realistic for me at this time. My lawyer said my chapter 7 is set to be discharged on or around August 15th. I'm not really concerned with getting large amounts of credit again, because I don't want to end up back in this place. However, i do want to know as far as building back up would i be able to be added as an authorized user with any of those companies? My husband has perfect credit (and spending habits) so he still has all of his in good standing and totally unaffected by my nonsense. He is more than willing to make a unauthorized user to help me build back up, but i don't know if any of those companies allow that?
also, has anyone else ever had student loans included in their chapter 7? The paperwork my lawyer sent me makes it appear as if my student loans are included, but I'm not so sure(i thought that they couldn't be if they aren't private loans) . Awaiting for him to get back to me....

The only creditor that will not let you be an AU if you burn them is AMEX. All the rest don't care. I don't know anything about student loans, but if they were dischargable, your attorney would have included them in your petition and your discharge in August would show them as discharged. Sadly, I think this is just wishful thinking. You already know the answer to this one.
Capital One will approve you after BK to get you started on your rebuild.
GL!
DON'T WORK FOR CREDIT CARDS ... MAKE CREDIT CARDS WORK FOR YOU!
Thanks for the insight on the AU portion.
The reason I was saying that about the student loans is, they are listed on the petition and they are included in the total as non-priority debt, or something like that. Also, on my credit report, they state $0 and the comments state "included in bankruptcy", but i didnt think that, that was possible.
Thank you! Do you know how long I should typically wait after d/c?

Two questions: Is Capital One being burned? If yes, were you already delinquent on it or was the BK the first delinquency?
The BK was the first delinquency
Hello there,
I would check in with your lawyer. Student loans are usually not dischargable but will still show on paperwork when you file. They might even fall off credit report or show closed but come back a few months later.
The student loans were added to the petition because even though they are not dischargable (to my knowledge) they still have an automatic stay in place during your petition. I owed sales taxes from a closed business that 100% are not dischargable but were added to the petition. A few reasons. 1. You must list all liabilities so that the trustee sees what disposable income you are left with. 2. what I stated above the "automatic stay" collections will be halted on all debts until your petition is discharged.
Thank you for the insight!!! I'm just glad this whole process will be over with soon. It's been a rollercoaster lol
