Long story short, need help on how to proceed with Veritas Instrument Rental company. Filed BK in August of 2010 and Discharged March of 2011. This account was IIB in the BK. Looking at the reporting on CR's I am trying to get it removed from EQ and EX. TU has removed it without issues. MY EQ has no reporting however Experian shows the following reporting below.
120 days 4/2009, 150 days 5/2009, 180 days 6/2009, 120 days 7/2009, OK for 8/2009, 90 days 9/2009, 120 days 10/2009, 150 days 11/2009, 180 days 12/2009, 180 days 1/2010, 90 days 2/2010, OK for 3/2010, 60 days 4/2010, May - July 2010 OK, 8/2010 120 days, 9/2010 150 days, October 2010-Feb 2011 OK, March 2011 Charge Off.
Been trying to dispute with EQ and EX and keeps coming back as vaild debit..... I want this account off my reports... Please look at the payment dates as they make no sense. Thinking aboout CFBD to file a complaint....Any advice would be appreciated

You will have to look at your court documents. One of the schedules, has the list of creditors. Make sure this account is listed. Very often, Attorneys make mistakes and fudge up the paperwork, as my Atty did. Once you have confirmed this account is listed on the court documents, make a copy and send it to all 3 CRA and the creditor. If your Attorney did NOT include this debt, they you will need to call the Atty to get clairification. Many times, it is very difficult to open a BK that has been closed or discharged. In my state, there has to be a major error in the paperwork before the BK Court re-opens a case.
You need to make sure the creditor lists the account as "IIB, $0 balance"
The account was IIB....I'm questioning the reporting. Please look a the reporting carefully and tell me if the reporting makes sense. How can I be current one moth and be 90 days the next month. How can I be current for a string of six months and then the next month have it reporting a charge off? I placed the reporting there from EX so people could see it and give me feedback. It seems like there is reporting violations. Also when does the 7 year clock start, for first delinquency or last reported.
Would it be possible for you to post a screen shot of the reporting (blacking out all personal information) - may make it easy to understand.

I would say to tread lightly as you do not want them to update and add more lates to your report.

If these are IIB and you can provide the documentation to the CB's, they have to start a process with the creditor. If you're saying that you have done this AND the creditor is providing evidence that the debt is still valid, you have a right to view the evidence and findings. If the CB is siding with the creditor saying it's valid, then there is a reason. I'd re-examine your schedule F and see what ACCT number was listed in the petition (just to be safe). If you're still having issues and getting nowhere with the CB's or creditor, then examine your rights under the FCRA. In section § 611. 'Procedure in case of disputed accuracy' [15 U.S.C. § 1681i] you have a right to reinvestigation and a right to examine all findings. The CB's are also not allowed to let the entry stay on your file without cause. They have 30 days to investigate, receive the data from the creditor and get back to you with a determination. Keep fighting..
