Can you get a Mortgage modification while in a Chapter 13 plan?
Yes you can. Well, at least you can do a refi - I would check in with your BK attorney to see if a modification meets the same qualifications as a refi.
And you know there's no such thing as a dumb question. Especially when it comes to finances.
Talk to your BK attorney - they may be able to recommend folks who can work with you on refinancing. And they'll let you know about getting trustee approval when you find a mortgage refi that you like.
And beware what you're offered.
I'm not sure about a modificatioan, but we tried to refi during CH 13 - our ARM (I agreed to getting into that in spite of my better judgment) was intolerable. Our FICO scores were pretty much smackered. In addition to the BK, each account that is IIB should report as IIB. There's an ongoing question on this forum as to whether they can report balances while you're in BK and are continuing to pay them off (technically, they are not paid off until they receive the total amount due or the BK is appropriately completed and discharged). Our mortgage gal spoke with one (or more) of the CRA's to see if our accounts were reporting correctly at the time, and the CRA's indicated that they were. So, in a nutshell, our scores were so low that no traditional funding was available. We did get some "alternative" funding offered to us - this would have reduced our monthly payment but increased our total amount paid substantially. We turned down the only offer that our mortgage rep could pull out of a hat for us.
On the other hand, one year after discharge, we easily refinanced. Our mid-scores were both about 723, and our reports (with a little work) were reporting properly. Our attorney told us we may have to just suck it up (we were already sucked dry) and get through it. That's what we did - and we lived.
So, I wish you the best on your journey. If you are able to get a better rate now, while you are still in BK, that is great! The trustee will approve it and you will be on your way! If it doesn't work out as well as hoped for, it will work out sooner than later. In the end, all will be well.
