Question about reporting after discharge

Hello.  What happened with this matter?  I filed in 09/2014 and the bankruptcy is supposed to come off my credit this fall.  In April of this year one creditor reported to Equifax which dropped my score 19 points and I disputed it but my credit report still says late within the last 2 months.  This debt was included and paid in my bankruptcy.  Today and I wake up and see I have an 11 point deduction with Experian for the same creditor.  For some reason they are reporting after 6 years of discharge and it's effecting my scores.  What can I do?

Good evening.  I have a few questions about bankruptcy and what I should do in this situation. In 2014 I filed Chapter 14 bankruptcy.  The following fall, I was discharged.  At the moment I'm in the process of purchasing a home and I continue to getting reports from one particular creditor.  My reports say the bankruptcy and the debt is set to be removed from my report this September.  What can I do to stop the reporting since it was included in the bankruptcy?  In early April of this year I received an alert on my Equifax report which dropped my score 19 points.  I disputed it with Equifax and they told me to follow up in 30-60 days.  Yesterday my score went up 14 points because I paid down debt.  Today I login and I see I have another 8 point deduction due to the same account I disputed last month.  The alert says it's a consumer dispute and a reinvestgation is taking place.  If that is the case, why are points being removed from my score each month?  Please help!!

Some of this is confusing.  I see you did some edits.  You say you filed presumably chp 13 but was discharged in less than a year.   Was it maybe a chp7?

Also, what do you mean getting reports from a creditor?   Were they included in the BK?  What are these reports you speak of, are they updating the credit bureau's of the debt as if it was not included in the BK?

 

Ok, I reread your post and it was included in the BK.  It will fall off your reports like any other delinquency.  Time is your friend for this.  Still confused how you got discharged so quickly in a chp13.

When you dispute something it forces an update and if it is a negative item that is being updated, it will most certainly drop your score if it is not regularly updating on it's own (without you disputing).

 

Also, when you dispute something, it may temporarily remove it from your scoring and it may temporarily raise your score while deing excluded, then once the dispute is completed, and if updated and not deleted and is a negative item, it is reinserted back into your scoring and will drop the score again.

 

Essentially, if it is not updating on it's own regularly, there is nothing actually incorrect (like disputing in hopes it will be removed or you believe something is innacurate, but since reporting can be confusing at times, but is not actually incorrect), I strongly encourage you to not dispute it, as it will only continue to keep dinging your scores.

 

If it is set to come off in September, do nit dispute it, as it will not speed up the removal. You need to look into the early exclusion process, and this early, it will only work for TU. You will just have to continue and wait for the items to age off naturally for EX (since they age off items 2 or 3 months early, anyway) and EQ, because they arent really ones open to removing derogs very early.

Assuming you filed a Chapter 13 (based upon your bankruptcy dropping this fall), is it also safe to assume you used an attorney?  If so, I'd let your attorney know about the "new" late being reported and ask for his or her advice.

Okay.  Thank you.  It's been months now and the bankruptcy is still on my credit.  It was supposed to be removed in October and it's still there.  I don't know what to do at this point.

Your post contains conflicting information:

  • On 06-May-2021 you said, "In 2014 I filed Chapter 14 bankruptcy."  There is no such a thing as a Chapter 14, however, you went on to say, "The following fall, I was discharged."  This implies you actually filed a Chapter 7 and the bankruptcy will fall off your reports in August of 2024.
  • On 13-Jun-2021 you also said, "I filed on 09/2014 and the bankruptcy is supposed to come off this fall."  This implies a Chapter 13. where the derog should have fallen off your reports in August of 2021.

Can you confirm what form of bankruptcy you filed?
