Upset with PenFed credit union

I had a PenFed overdraft line of credit for $500 that was included in my bankruptcy that discharged last July. Anyway I called them up and was trying to get a new account with them and was denied due to the old account with them. I asked several reps if I paid the old account off that was discharged in my bk would they grant me a new checking account. My membership savings is still open at this time and they said yes they would no problem I would just have to clear that balance out. So I payed the balance and waited a week just like they said denied for the old account again. I wasn't happy none the less. I called them again was told cannot open a new account due to the old account being included in bk. She said the account was showing paid. Well I have already been lied to twice saying I could open one. After she told me this I requested my money back since the account was included in my bk and they had no legal right to collect the payment to begin with. She said she would email someone and they'll be getting in contact with me. I received a email the next day asking me to call them and this were it gets interesting. This rep told me the payment has not been received and had the nerve to ask me to pay it again and I said it's already been paid and I need my money back. She kept insisting it had not been paid and I told her it was included in my bankruptcy. She said I would have to send proof of this even though they already knew it was. I sent in proof to them and someone was supposed to call me back this past Friday. No one called so I had my bank to send the payment back to them now if they try to collect this from me again my lawyer will take care of this. Will I have a right to sue them if they try to dispute this with my bank or try to collect this from me again? All they had to do was be honest with me and I would have never paid them back.

Yes I would be upset too. You are seeing if your bank will revers the payment. That is pretty much it. You have the right to fight them as they can not try and collect a debt after your BK.

I would also suggest that you forget using Pen Fed and go to a bank that was not included in your BK and start over from scratch.

You can't go after them because you chose to pay a debt that was discharged in bk. They weren't trying to collect. By your own admission you asked if payment would allow you to open a new account. Whether or not you were intentionally misled into making a payment is another story and going to be difficult to prove. Them asking after the fact is something you should take up with your attorney, but  you're the one that set the wheels in motion. You cant threaten them for collecting a bk debt you offered up to them.

You effectively paid a non-refundable $500 application fee to open a checking account with PenFed. I would never have done that. Your finances are more important than your relationship with a particular financial institution. I can open a checking account at almost any other credit union in the country for free. 

 

As far as suing them, your lawyer will not sue them for you for free. What you're asking from your lawyer is not part of the no look fee you paid in your case. You have to pay extra. And this is over a $500 debt, which is about one and a half hour worth of an attorney's time. You'd need to pay several thousands of dollars retainer to file an adversary. Just to rub salt on the wound, the court fee to reopen a 7 is $245. So it's likely they will laugh at your threats to sue over $500.

 

It's time to move on. There are many other financial institutions who will treat you a thousand times better and not trick you into paying $500 of discharged debt.

my bank got my money back from them so I'm good now. I also requested they close my membership well that hasn't even been done like they said it was so I'm done with them. I just got in with dcu and they opened me accounts no problem and even offered to refinance my auto loans at 1.99 if I have direct deposit to my account. I may do it after I buy my home in the spring time.

FYI when talking to anyone about a bk account you must

talk to the bk dept and not member services. They are the

only reps to give you the correct info.

I'm glad you posted this because I'm in the same boat. I didn't want to waste a hard pull if they will never open a checking for me again.

Im glad you let this one go; Its not worth the headache or fight. Solid CU's are everywhere, and PenFed is only one of the many large ones that have generous terms for credit products. I had a regional CU in my BK7 and they had great credit products. But I would never waste the time on them now as the hassle isnt worth it.
