What to expect during my meeting and steps to follow afterwards.

Hi All,

 

I have read many posts and the information that is given is so helpful for those who are at lost with their financial situations. I know my question has probably been asked and answered multiple times so I apologize for that in advance. I just heard back from my Bankruptcy attorney on Friday that she filed my chap 7 case and I now need to look out for the court hearing letter. Being that this is my first time and I have no idea what to expect during meeting or what to do afterwards I'd request any information that can be shared here. I know that I will not be repeating my mistakes by taking advantage of CC anymore and will only use what I can pay of in full to build a strong history.

I haven't filed BK, but I helped my fiance with his.  Basically, you will get a letter with your meeting date, location and time (make sure you show up on time!).  From what my fiance told me, he said he was the first case that was called, the opposing party(ies) didn't show up.  I didn't get a chance to go to the meeting because I was looking for a parking spot; I was still looking when I got a call from him on my cell phone, telling me that he was done!  All of that took less than 30 minutes...I was surprised!

 

About two months later, he got a letter in the mail from the courts stating that his BK was discharged.  Since then, with my help from the awesome people on this board, he is slowly rebuilding his credit; he has a couple of cc's with low limits and high interest rates that's being used responsibly, but when the annual fee comes up, we're hoping to SD or close those accounts and transfer any balances to a card or cards with better terms.

 

Just so you'll know, after you file BK, yes, it will be difficult to obtain credit; however, it's not the end of the world. Regardless of the reason for filing BK, you can get past this, it will take some time, but we are here to support you as much as we can.  Good luck on your future credit endeavors!

Thank you for that detailed information you've provided about your fiance's bankruptcy process. I wanted to ask you how long was it before he got the letter for his meeting with the trustee.?

You will attend a meeting with the trustee who will ask some questions. The meeting could last one minute [yes...really] or 30 mins [mine did] depending on how simple or complicated your situation is. The trustee contacted me by phone prior to my meeting so you may or may not have that as I did here in Florida. When the meeting is scheduled depends on the caseload of the trustee.

 

You did not elaborate on your situation so its anyone's guess but there is no need to worry or panic as questions asked usually relate to confirming stuff already on your filed documents plus taking an oath to tell the truth. That's all.

I only have unsecured debt and my case is very simple. I have 25K debt with is mostly Medical Bills/CC and my current scores for TU:601 EX:592 EQ:572 and I would like to see my scores to above 650 at least by  next July or earlier if its doable.!!! I currently have one CC which is from BofA since I bank with them and its a unsecured card. which I plan to use to build my credit and i also plan on getting a Cap One secure card to help rebuild credit . Any suggestions on what cards I should apply for in order to build credit. Also should I wait till my discharge or can I apply for a secured/unsecured card after my trustee meeting.??

I strongly urge that you do not apply for any credit until you receive your disharge.

 

As for suggestions on credit cards to use in your rebuilding efforts, I can tell you that I used two secured cards from First Progress Bank. Got both of them [$300 each] with a single online application.

 

As an FYI, I am about to close on a new home purchase and my ch7 discharge was in April of 2013.

Thank you for that information I apprecaite the help. Its great to see the progress you've made within a years of time and i hope to achieve the same or more if possible Smiley Happy. one other question I wanted to ask which is Did you have to send any letters to update the credit report or was it all updated for you once you got your discharge.?

Do not be suprised if BofA closes your credit card once they get notice for your filing (they did for cards I had with a zero balance).

They close your cards after you filed or after you got the discharge.?

They sure can.

 

And if you owe them any money when you file - they can freeze your bank accounts.

 

Our attorney told us to move our funds to an account we did not owe money to for fear of a set-off (I think that's what it is called).
