I have a couple questions as to what is allowed to show up on my report after BK. I've been in the process of actively cleaning up my report and found some items I deem questionable. So first off, if an account was PIF or never even used before BK, can a creditor even claim that it was included in BK? Second question I have, is I continued to pay on my car and boat loans throughout the BK, but is shows that the payments were 30,60,90 days late during the BK process. The loans were not reaffirmed but I did pay them off in good faith in order to keep them. My report shows these payments even though it also shows IIB! We also had a home loan that was included, but we continued to pay and later sold but it shows IIB because it wasn't reaffirmed, these payments did not show up. I want to dispute these items, however I do not want to reage the accounts by starting an investigation since it's already been 4 years. It was chapter 7 in case anyone asks. Any advice on best course of action or if anything can/should be done?
Were the creditors in question (the ones paid off) listed even though they had zero balance? A lot of lawyers have you list of all your creditors, if so they will report that way.
Were you late on said accounts prior to filing BK? If so they will remain as well .
I would have to look, but I assume the zero balances were listed, because our lawyer pulled our reports and put everyone in our BK balance or no balance. I even questioned him at the time, but he said it was better to be safe than sorry.....now I'm feeling pretty sorry I listened to him!! That's a little disappointing considering they had nothing but good standing! The auto/boat loans were always current even befor BK as well!
