can what you say during a Recon call reset the SOL?

Here's one thing I don't understand.

 

Burned Chase in 2014 for 5500. C/O, never paid, never got sued etc. Wanted to see if they "forgot" me and applied to Amazon Visa.. Instant denial. Letter says "due to previous derogatory or delinquent relationship" 

 

Everyone is giving a shot to recon line and tell them; yes it was the recession, I was going thru a divorce, I had a rough patch in life etc etc.

 

I wanna call for recon but we're always instructed not to admit to owing anything. I just don't want to get on the phone and say "yeah I got laid off and had a rough patch in life, so I couldn't pay etc" which is kinda admitting that I own the debt - and next thing you know, they record the convo and reset the clock, my $5,500 from 2014 comes back in the picture while I'm trying to get an Amazon card approved.

 

What do you think?

I think that Chase's memory is as long or longer than AmEx's is and regardless what you tell them as a reason you're still going to owe them that money as far as they are concerned and you're also never going to get approved for a Chase card until it's paid or paid as agreed with them. As far as restarting the SOL in my opinion and proabbaly their's and any courts if you try and give them an excuse why you didn't pay that debt you have in fact acknowledged you owe it and that would/could restart the SOL. Not worth it in my book since they probably wouldn't overturn the denial anyway. If you want back in with them you're probably going to have to pay them their money.

In regards to 'Reseting the SOL'...disputing a debt does not reset the SOL.  There are requirements that need to be met to consider the SOL reset.  That does not mean junk debt collectors will not try, by any means possible, to get money from you. Don't acknowledge or agree to anything about this old debt though.  You can work with Chase to settle the debt or just pay it...if you really want one of their cards.  

I personally would find a different card from someone other then Chase till the other matter is cleared up.

 

From experience, I had a junk debt collector call me, posing as a processor of a subpoena, of when I was available to deliver the doc but recommended I talk with some 3rd party on to what it was about. I called them...it was supposedly something from 2008 that is WAY past the SOL but they were willing to settle for less.  I informed them that I was not aware of what they were talking about but to go ahead and have the processor serve the doc and I will respond as necessary.  I did mention that the SOL on this, if it were valid, has expired  by several years and this should have been served many years ago.  They would not answer or acknowledge my point. I checked local court systems for any pending lawsuits, needs to have that started to even serve a subpoena in my state.  Oh the games they play.

Burned Chase? recon is a no go ..Just settled with Chase for nephew.. 30% of amount..doubt he gets in good grace wih Chase..

What you said is exactly the reason I closed my Amex card in 2017 prior to filing Ch 13.  Was just instantly approved in 2022 for the same Amex card only with 10x the limit of the original card.

 

Had Amex been IIB it would have never happened.

 

Never had a Chase card and do plan to get one of their cards one day but not until the Ch 13 related stuff falls off my reports.  I hear Chase isn't BK friendly even if they aren't IIB.
