Well, called and spoke to them. Explained a few things but the knockout was a foreclosure in June 2013. They like to see a couple years after that. It's unfortunate because it was from a divorce. I quit claimed the deed over to my ex wife and she let it go into foreclosure. It was originally delinquent in 2008 but was brought current again for maybe a year before it went south again. I wish it would have happened sooner as I would have more time on my side and be closer to it aging off.

 

Oh well.

 

Maybe I'll give it another shot after the end of the year.

I'm sorry to hear that happened to you. Do you possibly have any documentation reflecting you relinquishing ownership to the other party, divorce decree?

I'm sure I do, but I think I'm responsible regardless. She didn't refinance. She got the property but I had liability for the debt.

Well its good they gave you some feedback, but did they give you the exact amount of years between the foreclosure and application?

 

I would call again and state that the previous rep told you it was the foreclosure but you wanted to make sure they understood the circumstances behind the foreclosure and to reconsider you for the card.

I'm no legal expert but if you have supporting documentation such as a court document releasing you from ownership by the decree it would be certainly be something to persue. Hopefully one of our experts might be able to chime in.

Im not a lawyer either, but a any agreement by court or divorce agreement, does not release you from your loan obligation.

Thats true but how did she get the property? It should have gone back to the bank or to short sale in this case.
