AMEX told me to file a police report even though I don't think it's justified...

Hi everyone! I'm just looking for anyone with some insight or opinions about my situation.

 

On 2.16.2016 I bougth myself a new watch from Bloomingdales with my AMEX PRG card. Two weeks later, unfortunately, I lost it while I was at my mother's birthday dinner. I think I left it in the bathroom, because sometimes when I go to wash my hands, I usually take my watch off. 

 

So anyway, I was really pissed and a few days later my boss who is an avid AMEX user told me about Purchase Protection for loss/damage/theft. I was a litlte bit relieved but it sounded too good to be true. So I went online, checked to see if my purchased qualified, and filled out a claim. They e-mailed me asking me for original receipt etc., which I sent them on 3.4.2016

 

I didn't hear anything from them for 3 weeks, and I called them three times and they said it was still "processing" and to give it 10 business days (I thought I had if I counted it from the first). So someone today finally calls me (3.23.2016) and says that in order to process my claim, I have to file a police report and report it as "stolen." 

 

I told them that I never said it was stolen nor did I write on my claim form that it was stolen, but that I had lost it. She said, again, "Yes but you have to get a police report and say that it was stolen for us to continue processing this." And I was literally like "**bleep**? You want me to lie on an official document and say something was stolen from me when it was my irresponsibility that caused me to LOSE it?" and she just laughed. Literally. She said "Well, sir you need to fill out a police word and say it was stolen because to me, this scenario qualifies as it being stolen from you, not you losing it." I don't understand that because my benefits include theft AND loss. 


And I told her that on the paper I said I *THINK* I may have left it in the bathroom, not 100% sure--it could've fallen off my wrist while dancing, something I don't know--

 

Am I being dramatic? Should I file a police report and claim that it was stolen when in my heart I don't believe it was?! But that it was infact lost by me? 


I don't want to waste police time when they can be filing reports/using their time on more important things than filing a report about my $300 watch that Amex wants them to.

If you want to see what it's like to go to prison, file a false police report. Otherwise don't ever file a false police report.

edit: call back and ask for a supervisor, that is illegal i believe.

Well technically you did lose it due to theft, someone taking it after you left it somewhere, but to file it as a theft is just not really right.

Oh no, I would *NEVER* do that, ever. I actually left out a piece of information... so I told her "Okay, I will file a police report if that's what you're requesting, but as part of my statement on the report, I will state that I don't believe it was stolen but that Amex qualified it as being stolen and requested this report." And again, she just LAUGHED and said "Do what ever you need to do, sir."

Like others have said, do NOT file a false police report. I would definetly call and ask to speak to a spvr/manager. If they say the same thing, then I would call the police station and explain to them the situation and let them know AMEX is telling you to file a stolen item report and let them know it doe snot make sense to you. But I woudl def try to speak to a spvr or a mgr.

I'm not sure what state you are in so I don't know if it's legal for you to do this but if you can legally do it, I would record the phone conversation when you call AMEX back. In some states, only 1 party needs to be aware that the call is recorded (you).

I honestly think you should take that as a loss. I mean I know I would have. Stuff happens. No big deal.

Well you can check with the police and say you are not sure if it is lost or stolen, but its obviously not where you left it so someone took it. Maybe the police will take the report in case someone tries to pawn the watch etc. I would NOT lie though and say it was stolen if you don't know. Amex can't require you to lie and it is a crime to do so when making a false police report. My first step would be to call Amex and get a second opinion. If the person sticks to this then ask for a supervisor. You are claiming that amex will cover loss as well as theft. Well if that is the case they don't need you to tell the police it was stolen when it may be lost If the police allow reports for lost property then I can see amex requring that. .

Well considering that you left it somewhere and lost it, someone has it by now and is using it, aka stole it.

Call the police. Fill out a report. Tell the truth. A theft DID occur. Someone took your watch that you left in the bathroom. Let the police decide if there was a crime committed...

 

if if there was a bag of money on the floor, and you took it, you would be charged with theft if they found out it was you....
