I recently got married and when my wife and I added each other as AU's on our accounts, many of the issuers had a question on the form as to whether or not we wanted a card to be sent to the AU.  Why would they give the option of not having a card sent to the new AU if it violated the terms of the contract?

Because it doesn't.  There is nothing wrong in doing that and it doesn't violate any contract.
