You need to first file a police report. Everything you need to do to try and fix this will need that police report.

yes they were all hte same merchant account i think. i'm working with a lawyer but the law is

not very effective in this particular case. its hard to get them to take it seriously.

It's been a long, long time since my BK (1990?), but I and many others here have survived it. It depends on the bigger picture of your life/personal situaiton, but the suggestion to check out the BK board here is a good one. Since you know your credits already pretty damaged, it may be your best option. I am always SHOCKED at how quickly I read here about people rebounding in a big way. I am sure I just felt sorry for myself, stuck my head in the sand and wallowed around for 10 years.

the police yes. the lawyer i spoke to said said the police have so many cases like this it doesnt even register on their radar

so i'm thinking about suing rather than criminal case.

Disclaimer 

I'm not a lawyer or police but the lawyer may be correct because it isn't fraud when you gave him either the physical card or added him as AU to use the card 

Which basically boils down to you being responsible for all charges 

Please clear up this fact ....did you give him the card or access?

Keep your head up.  While I'm sure this is very stressful (it would be for me also), there is always better times ahead.  Even in the worst case scenario and you have to file bankruptcy, it's not the end of the world credit wise.  There are many of us here that have been thru either bankruptcy or other serious financial situations that end up doing well for themselves.  In the end you'll end up wiser and ahead of the game.  Wish you all the luck.

i gave him the card and he used them to get the money off. when things went bad, i canceled all the cards and

had the banks issue me new ones.
