Ideally, the merchant is at fault either way whether it was unintentional or not. To me, it sounds intentional, but that is my opinion. However, the merchant has the responsibilty of verifying the card user by verifying the name and signature on the card matches the name and signature on the receipt. It goes without saying, merchants 99% of the time NEVER do this (at least in my experience). However, it bothers me as well that Discover is lazily overlooking the fraudulent purchase using your card which is why I would take up the issue with them. Of course you can go back to the merchant, but that doesn't fix the situation with Discover overlooking the problem. Discover assures customers of protection on purchases not made by them, they need to stand up and own their promise to their customer... not make you do the work for them. Keep us updated.
I'll definitely keep you updated. I'll either be calling Discover tomorrow morning or heading to the Eco Depot Thursday, just not sure what Ive decided to do just yet. Most likely be doing both.
So as of yesterday I finally had my money refunded for good. Took 3 months!!! Not only that but I had to take the receipt Discover "found as proof" with somebody else's signature and take it back to the location and dispute it myself. Had to go back twice. So to paraphrase, I disputed a charge that wasn't mine, Discover refunded me back the money, then took the money back out because the company found proof which was a receipt with another persons signature on it (seriously!!?? how did they not see that), I went back twice to argue with the company and a month later got refunded my money back for good. Basically Discover blows when it comes to "fraud protection" and you'll have to do all the work on your own and it could take months. Maybe they really did mean frog protection on their commercial because their fraud protection is terrible. My experience so ymmv but I'll be using my Discover very little for now on, especially since they don't offer me a Credit Limit increase button for my low limit.

Glad to hear everything resolved itself. Sorry that you had to go through all of this! I'm kind of shocked at the way Discover handled this. Usually they are pretty good in the CS dept. Oh well, at least you have your money back!

I'm with you on this, and to be honest It's not the time frame or even the fact that I had to go do the work myself, but the fact that they took the money back out of my account because they "found proof that I made the purchase". The proof was a receipt signed by another man whose name was far off from mine. That left a BAD taste in my mouth. Not happy with it.

Is there anything you can do to escalate this to someone for review? Because it really is not cool. And it has me worried... if this can happen to you, well it can happen to anyone really.
