What should I do? Cap 1 question?

I have a charged off account with Cap one that is reporting and charging me an overlimit fee every month.  It has been turned over to a CA.  I have contacted Cap 1 directly through the mail and asked them for an account # and the amount owed, if I am going to pay I would rather it be them than a CA, however they have not responded to my letter.  They did respond when I sent them a PFD with a big fat NO.  I have a partial account # from my CR but not a total account #.  Should I just send the money with the partial account # to Cap 1 or they CA.  What to do since they are both reporting.

Sounds like Cap1 still owns the account-

Best you might get is Capone to remove the CA with a full payment-

CapOne is notorious for doing this. They turn down not only GWs (for the most part) but also PFDs. You can't DV them and they tend to pass folks along to the CA, while still owning and reporting the account. They tend to keep people in limbo and some here have been sued at the last possible minute prior to SOL running out. If you search around, you'll find some great stories and examples. Sorry I couldn't offer much. Good luck.

There is discussion on Capitol Hill concerning the overlimit and late fees (and their accrual after the account has been frozen/closed) - most banks get away with this by HQing in a state that has no caps which is why Congress is looking at it.
 
The banks will be lobbying real hard against any limiting legislation and every consumer group pushing for it.
