A bitter divorce

My husband and I are in the process of getting a divorce.  I've moved out of the home and he currently resides there.  He has made payments until three months ago when he received divorce papers from my attorney.  Currently our mortgage is sixty days deliquent, the house is on the market for sale (no offers) and he has stopped making payments.  He has changed the locks, and refuses to pay the mortgage but has purchased a new vehicle.  My credit is being ruined as a result.  What can I do?  Can I do anything to help out my low credit score?  The only deliquent account is the mortgage.  No late payments, or collections or judgements.  Help please, my credit score was 714 before all of this happened.

Besides kicking him out of the house and making the paymens on your own?

The only way to save your credit for now will be to make the payments on the mortgage and keep it current.

(In the divorce proceedings you can always have the judge order your STBE to reimburse you his share of the payments)

Even if, in the divorce, the judge decrees that your STBE must pay the mortgage, that does not change the relationship between you and the mortgage lender. You will ALWAYS be responsible for it. Smiley Sad

That being said, you can "force" your ex to refinance it under his name. How good is HIS credit?

Otherwise, you can also sell the house.

But, yes, speak to a GOOD divorce atty ASAP!!

I survived (barely) the same situation.
 
My judge would NOT force the refi. and the lender filed a foreclosure. His dad bailed him out in the 12th hour, but my credit was trashed none the less. I sent countless GWs to the lender, explaining in detail the denial for refi and the divorce decree to no avail.
 
The only good thing is that it is due to fall off my CR in 1 year.
 
Best of luck (and hire the biggest a**hole attoney you can afford!!!)

not sure what state you reside in but he is not allowed to change locks until it is ordered by the court that he will be awarded the home. If you can afford the home, ask for the house as part of divorce proceedings. Also, call your lender right now to work out an agreement to get back on track. If you can maintain then by all means do so. Is the house in both your names or just yours? oh, you can also get a sheriff or constable to go with you to order him to let you in the house since you are still legally part or whole owner of it. I will NEVER leave my house for anyone.

I suspect his credit is being tanked too with the lates on the mortgage. I would call the mortgage company and ask if they would let payments slide and charge interest until you can pay. They have done things like this before. Smiley Sad

If you can afford it, please get a credit monitoring product and remove him from all your accounts to cover yourself.
