Hi all,
In 2009 I went through a divorce. We had two auto loans together, which we paid off when the divorce was finalized. I was also an AU on one of her credit cards, which we paid off and she removed me from.
Today looking at my credit report I have both auto loans still being sown as open, but with a last reported date in August 2010 (when the last payments we made). I also show that the Capital One credit card is shown as open but the last reporting date being 12/2009 (when we split and I was removed from it).
So my question is, how do I go about getting those removed from my credit report as being open? Do I have to contact the agencies or the banks? I went to apply for an auto loan and the finance department showed that I had the two auto loans still open, but they believed me when they were closed when I showed the pay off receipts.
Thanks!
If you are no longer an AU the CC shouldn't even be on there. If you dispute as not yours with the CRA it should be removed.
You can always call the OC of the auto loans and ask them to report correctly.
Once a furnisher has reported any information to a CRA, they are required under FCRA 623(a)(2) to promptly update their reporting so as to maintain its accuracy.
I would not involve the CRA. That will place an unecessary dispute flag on your file. They cant independtly resolve the dispute, and will simply refer to the furnisher.
You can do that yourself.
I would send the furnisher a direct dispute under section 623(a)(8), with the inaccuracy being their failure to timely update the current status of the account(s).
That applies regardless of the type of information.
Thanks for the responses.
Is it best to submit these requests in writing over snailmail or is calling them better?
