Alliance One problems....

I currently have an account that was charged-off with Capital One and Everytime I call I am transferred to Alliance One.
 
I have conversed with a few of their representatives and offered a PFD method of solving both of our problems.
 
The collection is currently for $779 and I have offered to pay the debt in full in exchange for them to sign a contract I have made out that basically states that they are to required to report the the credit bureaus that the debt is settled in full and should be removed from their records upon reciept of payment.
 
I never get to the point of faxing the contract because they always are so fast to shoot me down saying "Capital One" does not authorize them to delete anything from the credit report and everytime I call there is mysteriously no one else to talk to.
 
Does anyone have pointers?

#1  NEVER talk to a CA!  everything in writting.
 
We need more info. in order to advice you.
 
Who is reporting on you CR   cap1 or CA  or both?
 
Cap1 is almost impossible to work with.
 
  We need dates which you can get from EX and TU  CR. DOFD dates.
 
You need to know your SOL.
 
dealing  with a CA...you would send a DV.....CMRRR

Point taken...

Capital One is actually the only one reporting this with all three Credit Bureaus.

My DOFD date is 05-2006.

I am in Texas for it looks like my SOL would be 4 Years...

... how would I go about doing this? ...Is there any specific format?

I would suggest talking to Crap1 and asking them if they would open a new account for you and put the balance you owe on the new card and remove the old TL from your report. Since you will pretty much not get a PFD with Crap1 otherwise this might be a path to investigate. I read somewhere that at least one person was able to do something like this with them. Even if they gave you a card with only what you owe as a balance for a CL you can make a quick payoff and then sock drawer it and it would remove your bad TL. You would definitely need to talk to Crap1 to do this but it might be worth a try..... I have 2 settled accounts with them that I would do this with in a heartbeat if I knew they would work with me on. I was thinking about doing trying this if my score can't get the last 6 points I need to hit 680 for my mortgage rate I want.

I seriously debated doing something like this.... since this was my oldest account and quite a few charges slipped past me to say the least...hah. This is also the ONLY revolving credit line I have on my credit and it is obviously maxed out. I have a few late payments on college loans(everything is current now) and then a collection with Bank of America for $365 that I need to work on also.(Other than that there is nothing else negative on the CR)

the thing is.... they originally gave me a 500$ credit limit and the card is up to 779$ now.(& my credit score is around 520) Do you think they would do that?

and secondly every time I call Cap1 and type that account number in it automatically transfers me to alliance one... Is there a specific department I should ask for?(before I type in the account # and get swithced)

Nothing ventured nothing gained right? I have no idea who to speak to for this since yours is not paid or settled yet. Maybe you can settle for 40% of what you owe and when it shows paid call up Crap1 and offer to have them do the card for you the way I described earlier. I hate Crap1 and would only do it if I absolutely needed a couple points fast......

I also debated on this BUT after doing my research Alliance One is notorious for reporting "Settled for less than owed" or applying the 40% to the balance even after receiving it in writing...

Wouldn't trying to keep the account open be more beneficial to me... or no?

Since Alliance is simply collecting for Crap1 and is not on your CRAs I wouldn't worry about this. Crap1 owns the debt and Crap1 is the only one that can do anything with your TL from them.

Bamf- My BOA collection is with NCO, I seen that you had previously had success with them...

What would you suggest my plan of attack be?

Alright .. I'm stuck. Ive sent out PFD's CMRRR to both Alliance one and Capital One. From here I also blasted out emails to both companys with PFD's included. I got one email back from the vice president of alliance one...of all people...
