I was never served papers for the judgement. I have them, but I was never served... Does this make a differance?

Please if you need more info let me know. I don't want to pay this and then find out I could have done something better.

Re: Am I SOL ????

No, Like a dum dum I was told not to worry about taking care of the past, that it would only hurt. My dad stil lived at that address and I got my mail, I just wasn't served personally. I got the copy they sent in the mail.

So you think their timeline is off? I don't understand any of the technicalities of all this. You think I have a case to have it vacated? or whatever? I'm not sure what its called or how to go about doing it.

Re: Am I SOL ????

If they sent it certified mail and your dad signed for it then, I *think* in Maryland, that constitutes proper service. Try google to see if you can look up Maryland's service requirements.

Where is Lady Scarlet??? She's in Maryland I believe.

Re: Am I SOL ????

No, What I'm saying is that... they tried to serve anyone at the house and my parents were never there at the time. So no one ever signed for the papers on my behalf. They sent a copy snail mail, thats the only reason I got them.

I did a cursory glance at service requirements and for mail, it looks like it has to be certified and signed for.

Check with Scarlet, I am by far the last person you want to guide you. Smiley Wink

Re: Am I SOL ????

CALL the court and ask.  But to my knowledge it can only be done by:

• Certified Mail
• Private Process
• Constable
• Sheriff

Now, you have to understand that certified mail does NOT require a Sig of yours - only that it was delivered.  Call the courthouse - they should have the certified mail number (which you can check with USPS)..

If service was improper then you can have the jusgement 'vacated' for improper service.
