So about 18 months ago I went through and paid off everything on my credit report to get it all cleaned up. Well a few weeks ago I started getting calls from Asset Acceptance LLC and I'm trying to figure out what this is for.
The most recent was about 30 minutes ago and I called them back. I asked what they were calling regarding. I gave them my phone number so they could look up my account.
Here is the fun part. They can't find any account with that number. They ask me if their is any other number it could be that they called me on. Nope just my cell phone that you called me on and I am calling you back on.
The gentleman then tells me it must be an error on their end and not to worry about it. Sorry for the trouble he says.
Now the only things listed on my credit report I took care of in March of '10 all of these items have been removed from my report save two that I am disputing to have removed since the CA's told me by phone and in writing that they would.
Anything else I might have floating out there is over 10 years old and past the SOL in Iowa as well as not being reported on my report although I don't know what that would be since everything I took care of almost two years ago I recognized.
I don't want to ask too many questions over the phone to these people if they keep calling me since the name they are asking about is me. I don't want to accidentally validate them and reset the SOL. If they can't even find an account based on the contact phone number they keep calling what can I do to find out what this is about.
Any current accounts I have are not in collections. My student loans are in deferral while I am back in school and are up to date. My car was purchased from a family member and is paid in full. My condo is in my wife's name and she has immaculate credit. The only other things I have are a single credit card I am using to help rebuild my credit that is paid in full each month and the cable and internet bills that are also paid in a timely manner.
This is really starting to annoy me. Any ideas?
Thanks all.
You can write them a letter and tell them to stop all phone calls, that you want all communications by mail only.
Or there is another letter called a cease and desist.
Here is some threads about C & D letters, searched in the General Credit Topics. You can change the search to include the other boards too, if you want to.
Hope this info helps.
This will work however I'm curious about what they are wanting in general. They are calling and asking for me but I don't know what it could even be about. Let alone they can't seem to even find any account based off my phone number that they are calling me on.
is there any chance that you could answer the phone when they call? They should have the account pulled up in front of them when they call... I hope you get to the bottom of this soon.
Hopefully. Last time they called I missed it by a few seconds and had to call them back.
Let us know if you do catch an incoming call and how it goes.
One of the primary purposes of FDCPA 809(a) is for situations where a debt collector is communicating with you, and you are unaware of the specific reason.
A debt collector is required to send you a collection (dunning) notice within 5 days of any initial communication with you, advising you of the debt, the creditor to whom the debt is owned, and how to effect your debt validation rights. Apparently, this debt collector has not complied with their dunning notice obligation.
If they call again, I would simply tell them that you are awaiting their formal collection notice, and hang up.
I would not send them a formal cease communications letter under FDCPA 805(c) at this point. You can accomplish the same thing and more at this point by sending them a DV letter, which, among other things, invokes its own cease communication bar on them until such time as they have provided validation of the debt.
A formal cease communications letter would just unnecesarily complicate communications at a time when you already have a cease communications bar in place for items other than a dunning notice or DV response.
Hi Noodles - it would make me mad too. Are they going to send you validation of the debt so you know what they are talking about?
