Ok so the last call I recieved was on October 22nd. They said they would send a validation letter and I still have not received it. It has been more than 5 business days.
What are my options now if they attempt to contact me again.
Send them a DV letter or a cease and deist letter.
Asset calls me too. Every morning at 8am, I don't even need to set my alarm clock anymore. LOL
They call my home phone, which my DH and I don't answer, just let all calls go to the answering machine.
We have cell phones, but we don't let out the number, only family and friends have it.lol
What get me is, Asset is calling on a debt we already Paid for years ago, to another CA. The last 2 times I was contacted about the debt, I fax over the proof that this debt was paid.After I send the proof, another CA starts to call again. I don't know how to get them to stop selling this PAID debt over and over again, so I have to just ignore it. It's not on my CR any longer,it's about 9yrs old and paid for, so I'm not going to worry about it. If the phone starts to bother me, I send a C and D letter.
There is no 5day law associated with DV letters.
Unless you are talking about....The CRA must provide in writing to the consumer no later then 5 business day, after the date of the reinsertion of a disputed item on a CR.
The reason why they are calling you is...........They want money.
They think that you don't know the laws or your rights, and that you will just pay this debt, no questions ask.
When they know you are smart enough to know your rights and the laws, they will probably stop bothering you or just sell it to another CA.
ok well I guess that's where I'm confused then. Whatever this is they are calling me about isn't even on my credit report and as I mentioned before the company they said they are collecting for is a couple of things. Either more than 10 years old (I don't have exact records of it since it was when I lived in the Chicagoland area) or still the same thing but one of the debts I paid off more than a year ago.
Either way since I don't have enough information and don't want to run the risk of re-setting the SOL I am trying to do as little talking to them as possible. that is why I asked for a DV letter last time they called.
I'm probably using a bunch of wrong terms for describing what is going on but I really need to get ahold of my bank and get copies of payments made during the week I paid all this old debt off so I can really see what I paid.
The problem with that though is it will probably only show payments to the credit agencies instead of the actual places the old debt was owed to.

I could have typed this thing up in MS Word. There is no other information on it other than the name of the company that the debt is supposedly from and the ammount supposedly owed.
No supporting documents whatsoever to actually validate the debt.
What do I do now? I'm going to be contacting my bank on Monday to look back at my records from a year and a half ago. Whatever this is still isn't showing up on my CR.
I'm starting to get pissed with this company and their shenanagins. What steps can I take to make sure this goes away.

That's all that is required. Supporting documents don't have to be included.
