Hey guys, I'm looking for a little advice. It appears that someone may have attempted to get a loan with my SSN through cashcentral. I have Identity Guard credit monitoring, so I got the alert this morning about an inquiry yesterday. The comany seems legit, so I contacted them this morning. Initially I was hung up on by a rep when I wouldn't provide my banking institution, but after I got a supervisor that claims to have marked my information as unfundable, and is processing an inquiry removal.
I am going to call the bureaus shortly to place a freeze on my account, though my quiestion is more regarding the police report. Should I file that locally, or with the PD for the location of the lending institution, or my local PD? I started the FTC report, but it is asking for the PD information. Also, anything else I should do?
There is no requirment regarding the jurisdiction of the law enforcement agency, only that false statements subject the person to creiminal penalties, which is the entire reason why the statute accepts a police report as being more than a mere allegation. See FCRA 603(q)(4).
You additionally need to determine whether you want an extended fraud alert, which the policie report justifies, or a freeze.
A fraud alert is defined under the FCRA, and basically requires that you be contacted prior to approval of any new credit, while a freeze is more comprehensive, and the provisions vary depending upon the CRA or the statutory provisions of your state statute.
Thanks Robert.
I would rather have an alert than a freeze, I do plan on needing legitimate inquiries every 6-12 months, though I don't mind if I have to be contacted/verified prior. I will probably call the PD local to the lending agency, since there haven't been any new inquiries since.
Pay to have your credit reports frozen, it only takes a couple hours to have them unfrozen online.
File it locally, its sometimes hard to file it anywhere else. Where I live I was able to file the police report electronically. (No person of interest, no firearms or drugs stolen is an online form here)
You can freeze your reports for 90 days for free and include a phone number to contact you to provide access to reports.
(we did this, easiest route, not permanently frozen and its only 3 months)
Good luck, that crap is annoying and once its there sometimes very hard to get rid of.
