Best course of action - Collections

On September 10,2007...I contacted Pinnacle Financial Group to accept settlement offer. I talk to a supervisor and was told they would send out a settlement letter.  Which I have not receive. I do not have any documentation from the company stating that they are collecting the debt for Premier. THey claim they mail something to me and it could have possible been passed off as junk mail. I am afraid that if I send them any money and I have no documentation that it will not go in my favor. I recently went online to ripoffreport.com and located them on their and people said some scary things. I am trying to fix the debt but not trying to get screwed later.

First of all make all your contact in writing.  Apologize that the settlement offer had not been received and that you would happily consider it if they would resend.  Ask if they would consder the settled amount for deletion of the collection from your credit report.  Send all mail certified return receipt

Don't send anything without a PFD for sure, and it's certainly not too late as the best time to negotiate is while you owe.  Please make sure you read the FAQ Credit scoring 101 etc.   Don't ask them to re-send you another settlement letter... just study up on the PFD info.

The could offerPFD upfront butthen it would not be for the settled amount.  I woyuld request a copy of the settlement with an express intet to PFD.

Re: Best course of action - Collections

My personal feeling is that requesting another settlement letter is stirring the pot against her.  I'd recommend referring to the dollar amt. offer in her PFD though for sure.  I think the nego room may not be as wide though since now they know what she is prepared to pay.

Then again, it might be more time efficient to call back the supervisor and agree to a PFD for them to send out to her.

Re: Best course of action - Collections

COCO, first  what does you CR say about this CA.  Do you know who the OC is.

I would first send a DV letter. This way they MUST send info. or stop reporting. They also must show that they own or are authorized by the OC to collect.

Check with your state & see if a CA must be licensed and is so are they!!!!!

know your SOL
updated and more detail

NEVER talk to a CA on the phone....everything in writting!!!
