Blank application.

My x went into his bank and applied for a $5000 line of credit and a $5000 credit card.  He made it a "joint" application because he had already been turned down by his bank when he applied as a single person.  The bank told him he would only be approved with a good credit co-signer.

 

I was unaware that this happened until I went to get a mortgage.  The mortgage company told me to pay off the $10,000 in debt and they would consider me for a loan.

 

Through a lot of hard work, the x's bank finally wrote a letter saying that the debt was not mine.  The mortgage company will NOT give me a copy of the letter.

 

 

I have been fighting with the bank now for more than 2 years trying to get my name off the debt.  I have paid off the credit card several times and FINALLY got them to cancel the card.

 

The line of credit is attached to his bank account.  I can not get that one paid off fast enough for it to have a zero balance and for them to close it.  Nor can I get them to remove my name from it.

 

From the start, I have NOT had access to either the credit card or the line of credit.  The x finally admitted that yes, he opened them using my credit because he needed them.  The bank finally produced a copy of the application -- my signature is NOT on the form.

 

How do I get them to release me legally from this debt???  They have refused to do so, despite many phone calls, letters, and branch visits.

Time to talk to a lawyer. Inform the bank (or have your lawyer inform them)  that as you did not sign the joint application form they must remove you ASAP. Send this certified mail along with a copy of the application that does not contain your signature.

If that fails you may be able to sue either/both your ex or the bank for fraud.

Thank you.  

 

I have wanted to avoid the whole lawyer thing because it would cost me MORE money!   But that may be the best path to take, since the other ones have not worked well.

I can understand wanting to avoid the whole lawyer thing. In cases like this I think you are better off with someone on your side who knows your rights.
