BoA ignoring my Opt-Out!

I filled out the permanent Opt-Out form probably 6 years ago.  No one ever sends me anything...just as I like.

 

Over the last few months, I have twice now received credit offers from Bank of America.

 

I called them & gave them only the info I knew they had...my name & address.  The guy on the phone said he needed a phone # as well.  That was SO not going to happen.

 

Wouldn't their mailings to me be illegal??

 

What's my next step to rectify this?

Annoying, yes....but not illegal.

 

Opting out only tells the CRAs that they can't sell your information for promotional / insurance related offers ~ BofA likely has other channels to obtain customer information.

 

For example, any company that you've done business with likely keeps customer / address info on file for some period of time, which they can certainly use to target you, unless you've instructed them not to do so.

+1.  These opt forms are like the national "do not call list". useless.  I made the mistake of cancelling a landline and using the phone number for my cell phone.  The only good thing is that I can block these calls.....

Ok...gotcha.  What's interesting is that after going the "opt-out" route...I never get any unsolicited crap.  Haven't for years.

 

With BoA...I had pplied for one of their cards on 2 occasions many years ago (couple years between each attempt) and both times they turned me down.  That was about the time I became obsessed here!  haha  I figured they could basically pound sand...other cards greeted me with open arms!  Like I was in on the Nationwide bank card frenzy.  Made sure my TU report was clean as a whistle & got the 10k!  Also got some major love from NFCU for 25k.

 

So...I guess it was the old apps with BoA & they kept my mailing address. 

 

All that being said, I still don't want their junk mail, so what's my best course of contacting them?  Snail mail?  Email?  Anyone got a good address?

The additional wrinkle is that offers made by obtaining your name from sources other than a listing provided by the CRAs are even "junkier" than those obtained via a listing obtained from a CRA.

 

If a creditor sends an offer based on a listing obtained from a CRA, that offer is required to be a "firm offer for credit."

Having obtained benefit of CRA screening to determine whether you meet the criteria they provided for generation of the listing, they must then (1) make an offer to everyone on the listing, and (2) honor that offer if the consumer then applies and is found to continue to meet those criteria.

 

However, if they send an offer not based on a CRA pre-screening list, it is not required to be a "firm offer for credit."

 

Not sure if your state has any provisions barring offers made by creditors who obtain names from sources other than a CRA.

I am not aware of any such state prohibitions.....
