ok - so I am going to DV and see what happens - I will keep you posted.
This DV letter I am sending is actually being sent within 30 days of their letter to me. So I think they have to respond even though I PIF (doh! still kicking myself for that - literally found out it was the wrong thing to do hours after I PIF).
I also wonder if they will take the time or care to respond considering it is PIF. If that is the case can't I send all the info to the CRAs with the certified mail info and DV letter explaining they did not properly show me validation and therefor can you (CRAs) remove this from my CR?
Is this perhaps a loophole I found for a work around PFD??
CRAs dont care if the CAs did not validate to you. As long as the CAs verified to the CRAs, they will continue to report. They will simply consider your mail as another dispute.
Keep your DV letter very short and simple and ask only for validation under FDCPA which includes copy of debt, name of OC and Balance.
after reading another thread from the Moderator 'sidewinder' - it seems like this has a legitimate chance of working - let me know what you think:
Also I found a pretty good DV letter on the forum - just plugged in my info, it is a bit long but seems pretty good:
I used the 1st letter that 'HappyDays' posted.
yeah - doh! I did send it with all that info. This was like the last day I could send it and I rushed it a bit.
Well, it does also say you can't report it to the CRAs as well - so... That's the only important thing. It might sound silly to have that other stuff in there about ceasing collection action because I PIF - but I don't think that will hinder the effort to remove it from the CRAs - I hope?
Dont worry about it. You will be fine.
What was most important was that you responded within those 30 days.
excellent - that's what I was hoping be the main thing.
I am also starting a new thread about a few questions concerning proper DV letters and how to send them:
